R-06-04 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF COLTON RECOMMENDING TO THE <br />COLTON CITY COUNCIL APPROVAL OF AMENDMENTS <br />TO SECTIONS 18.20.120(A)(3)9 18.22.120(A)(4)9 <br />18.24.120(A)(5)9 18.26.120(A)(6)9 18.28.120(A)(6) & <br />18.54.020(A)(1) OF THE COLTON MUNICIPAL CODE <br />RELATING TO THE PARKING REQUIREMENTS FOR <br />EATING AND DRINKING ESTABLISHMENTS AND THE <br />KEEPING OF ANIMALS ON ESTATE RESIDENTIAL AND <br />INDUSTRIAL PROPERTIES: FILE INDEX NO. DAP -000-239 <br />& DAP -000-240 <br />WHEREAS, the City of Colton Community Development Department filed <br />applications in December of 2003, File Nos. DAP 000-239 & 000-240 relating to zone text <br />amendments to Sections 18.20.120(A)(3), 18.22.120(A)(4), 18.24.120(A)(5), 18.26.120(A)(6), <br />18.28.120(A)(6) & 18.54.020(A)(1) of the Colton Municipal Code relating to the parking <br />requirements for eating and drinking establishments and the keeping of animals on estate <br />residential and industrial properties (collectively the "Text Amendments"); <br />WHEREAS, the Text Amendments were reviewed, studied, and found to comply <br />with the California Environmental Quality Act ("CEQA") as more fully described below; <br />WHEREAS, on March 23, 2004, the Planning Commission of the City of Colton <br />("Planning Commission") conducted a duly noticed public hearing on the Text Amendments at <br />which time all persons wishing to testify in connection with the Text Amendments were heard <br />and the Text Amendments were comprehensively reviewed; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION <br />OF THE CITY OF COLTON: <br />SECTION 1. The Planning Commission hereby recommends that the City <br />Council adopt the attached Ordinance to amend Sections 18.20.120(A)(3), 18.22.120(A)(4), <br />18.24.120(A)(5), 18.26.120(A)(6), 18.28.120(A)(6) & 18.54.020(A)(1) of the Colton Municipal <br />Code relating to the parking requirements for eating and drinking establishments and the keeping <br />of animals on estate residential and industrial properties. A copy of the Ordinance as well as the <br />findings contained therein is attached hereto as Exhibit "A," and is incorporated herein by <br />reference. <br />SECTION 2. The Planning Commission hereby makes all applicable findings <br />with respect to the Text Amendments as set forth in the attached Exhibit "A" as if fully set forth <br />herein. <br />
