1 "The animal control officer shall have the right to receive and dispose <br />of dogs delivered into his possession by the owners thereof and shall charge <br />2 a fee in an amount to be determined by resolution of the city council, for each <br />dog which has not been duly licensed." <br />3 <br />4 SECTION 6: Section 7.08.070 of the Colton Municipal Code is hereby <br />deleted in its entirety and amended to read as follows: <br />5 <br />"The animal control officer shall have the right to receive and dispose <br />6 of any cat or cats, or kittens delivered into his possession by the owners <br />7 thereof and shall charge therefor a fee in an amount to be determined by <br />resolution of the city council." <br />8 <br />9 SECTION 7: Section 7.08.090 of the Colton Municipal Code is hereby <br />deleted in its entirety and amended to read as follows: <br />10 <br />"The animal control officer shall have the right to seize any dog, cat or <br />11 similar type animal within the city having or suspected to have rabies or <br />12 hydrophobia, or other diseases or sickness. In the event the animal control <br />officer shall determine that such dog, cat or similar type animal is afflicted <br />13 with rabies or hydrophobia or dangerous disease or sickness, the animal <br />shall be killed forthwith or as soon thereafter as same is determined by the <br />14 animal control officer. If such animal shall be merely suspected of having <br />15 rabies or hydrophobia, or other disease or sickness it may be quarantined by <br />order of the animal control officer for such time as the animal control officer <br />16 shall direct, and if the animal control officer shall thereafter determine that <br />17 the animal does not have rabies, or hydrophobia, or has a dangerous <br />disease or sickness, it shall be returned to the owner upon payment by the <br />18 owner of a fee in an amount to be set by resolution of the city council for any <br />costs to the city for the quarantine and care of the dog while it was confined <br />19 pursuant to the direction of the animal control officer." <br />20 <br />SECTION 8: Section 7.08.130 of the Colton Municipal Code is hereby <br />21 deleted in its entirety and amended to read as follows: <br />22 "In order to protect the public health and safety all dogs, cats, or <br />23 similar type animals within the city must be vaccinated with canine or feline <br />rabies vaccine, as appropriate for the species of the animal being <br />24 vaccinated. It is unlawful for any person to own, have an interest in, harbor <br />and feed, or have the care, charge, custody or possession of a dog or cat <br />25 over the age of four months unless such dog or cat has been vaccinated with <br />26 the appropriate rabies vaccine by injection or other approved method by a <br />duly qualified and licensed veterinarian or unless such a veterinarian has <br />27 issued a written certificate that such a vaccination might be fatal to the <br />2 8 animal due to its physical condition and such certificate has been filed with, <br />and, for dogs, a license issued by the city for the animal." <br />3 <br />
