Item #17 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF JULY 612004 <br />TO: HONORABLE MAYOR AND COUNCIL MEMBERS <br />FROM: ERIC R. FRASER, DIRECTOR OF WATER & WASTEWATER OPERATIONS <br />SUBJECT: APPROVE THE AWARD OF CONTRACT TO SOUTH WEST PUMP AND <br />DRILLING, INC., FOR EMERGENCY REPAIR WORK ON WELL PLANT NO. <br />26 IN AN AMOUNT NOT -TO -EXCEED $50,000 <br />DATE: JUNE 2412004 <br />BACKGROUND: <br />Well Plant No. 26 is located at Walnut Well Field in San Bernardino and provides forty percent <br />(40%) of the water to the Western Zone of the City. <br />Over the weekend of June 19, 2004, Well Plant No. 26 unexpectedly stopped pumping water. <br />Water Department Staff consulted with the City Manager regarding the situation. The City <br />Manager declared that an emergency condition existed and that immediate action was necessary <br />to insure that the reliable delivery of a pure, wholesome and sufficient supply of potable water is <br />maintained throughout the City. <br />DISCUSSION/ANALYSIS: <br />On June 15, 2004, the Colton Utility Authority ("CUA") awarded to South West Pump and Drilling, <br />Inc. ("South West"), the contract for rehabilitation of Well Plant Nos. 19 and 21. Both of these <br />wells are located in the same vicinity as Well No. 26. South West was preparing to work on Well <br />Plant Nos. 19 and 21 at the time that Well Plant No. 26 broke down. Because South West would <br />already be working for the City close to Well Plant No. 26, the most practical and cost efficient <br />solution was to engage South West to begin repairs immediately on Well Plant No. 26. Water <br />Department staff consulted with the City Manager, who concurred that the situation was an <br />emergency and that having South West begin the repair work on Well Plant No. 26 was the most <br />practical and cost efficient method for obtaining the necessary emergency repairs. <br />The actions of City staff in this instance complied with the City's existing purchasing regulations, <br />which state that competitive bidding, either formal or informal, is not required in situations <br />determined by the City Manager to constitute an emergency for a public project, pursuant to <br />Public Contract Code sections 22035 and 22050. (Colton Municipal Code § 3.08.130.) Under <br />such conditions, any alternative procedure may be used. In addition, the City Manager has <br />authority to declare a public emergency and take any directly related and immediate action <br />required by the emergency, up to a total of one hundred thousand dollars. (Ibid.) The contract <br />award to South West for the emergency repairs will not exceed fifty thousand dollars. <br />
