CITY OF COLTON AGENDA REPORT FOR CITY COUNCIL/CUA MEETING OF JULY 20, 2004 TO: HONORABLE MAYOR AND CITY COUNCIL FROM: ERIC FRASER DIRECTOR OF WATER AND WASTEWATER OPERATIONS Item #19 SUBJECT: APPROVAL OF EXTRATERRITORIAL WASTEWATER SERVICE AGREEMENT WITH CITY OF RIALTO DATE: JULY14, 2004 BACKGROUND/ DISCUSSION/ANALYSIS: On December 19, 1999, the City Council selected Krieger and Stewart to provide design construction and engineering services for the Southwest 44 area water and sewer improvements. On October 21, 2003, the City Council approved the expansion of the project to include the design of the Riverside Avenue sewer lift station and force main. This expansion of the project was due in part to the City's expectation that additional development will take place in both the incorporated and unincorporated portions of the City located south of Agua Mansa Road and east of Riverside Avenue (south of the Rialto corporate boundaries). In order to accommodate that growth and development and provide wastewater collection, treatment and disposal services to properties in that area, Rialto and Colton have negotiated a wastewater service agreement. The agreement provides for the following: 1. Gives Colton the right to deliver up to 30,000 gallons per day of wastewater to the Rialto Disposal system for treatment and disposal. 2. Gives Rialto the right to discharge up to 35,700 gallons per day of wastewater to the Colton disposal system for treatment and disposal. 3. Provides each entity shall construct one connection point for their disposal systems. 4. Provides that Colton shall construct , at its cost and expense, a gravity main, wastewater lift station and force main for the collection, conveyance, treatment and disposal of wastewater. 5. Provides that Rialto will charge Colton the same wastewater treatment capacity payment that Rialto charges new development in Rialto and neither City will charge development impact fees. 6.
