Derleth, City Attorney <br />SUBJECT: Discussion Item: City Council Direction Regarding the <br />Adoption of the San Bernardino County Restaurant Grading <br />Ordinance <br />DATE: December 29, 2004 <br />BACKGROUND: <br />On June 22, 2004, the San Bernardino County Board of Supervisors adopted Ordinance <br />No. 3930 to amend portions of the County Code to establish a program for the inspection <br />grading of food for restaurants in the County of San Bernardino. The ordinance became <br />operative on October 1, 2004 and contains the following provisions: <br />1. Establishes an A -B -C grading system and requires inspectors to issue letter <br />grades to all food establishments in the County. All food establishments must post <br />the letter grade received so that it is clearly visible to the general public. <br />2. Provides that any food establishment that fails to attain at least a "B" grade <br />must correct the deficiencies and request a re -inspection within 30 days of <br />obtaining the "B" grade. <br />3. Provides that any establishment that is determined to be an immediate <br />health hazard will be subject to immediate closure regardless of the inspection <br />score or grade. <br />Although all restaurants will receive an evaluation by the County Health Department and <br />be issued a letter grade, only those restaurants located in the unincorporated County <br />areas or in cities that have adopted the County Ordinance by reference can be required <br />to post the letter grade to inform their patrons and the public. <br />The attached ordinance adopts by reference the County ordinance so that all restaurants <br />in Colton will be required to post the letter grade issued by the County Health Official. <br />Pursuant to state law relating to the adoption of codes by reference, the public hearing on <br />
