Item #13 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF JANUARY 18, 2005 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E., CITY ENGINEER <br />SUBJECT: AUTHORIZATION REQUEST TO SOLICIT PUBLIC BIDS FOR <br />CORPORATE YARD FUEL STORAGE TANK REPLACEMENT <br />PROJECT. <br />DATE: JANUARY 10, 2005 <br />BACKGROUND: <br />On March 30, 2001, the State Water Resources Control Board sent a letter to all owners and <br />operators regarding new regulatory requirements (see Exhibit "A") for underground storage tank <br />(UST). The new regulation requires UST owners and operators to: <br />a. Perform triennial testing of secondary -containment systems, including under -dispenser <br />containment. <br />b. Conduct triennial enhanced leak detection for single walled UST and UST system <br />components that are located within 1000 ft. of drinking water well, and <br />c. Install under dispenser containment for UST systems that are not equipped with such <br />containment by December 31, 2003. <br />In conjunction with the above new regulatory requirements, State Water Resources Control Board <br />had notified the City of Colton that the Corporate Yard USTs are within 1000 ft. of fresh water <br />drinking well and are subject to annual Enhanced Leak Detection Inspection. Violation of this <br />regulation can result in possible fines of up to $1.5 million. <br />On August 12, 2002, representatives from San Bernardino County Fire Department -Hazardous <br />Material Division -Certified Unified Program Agency (CUPA) inspected the Corporate Yard <br />Fueling Depot and found numerous violations as shown on attached Supplemental Inspection <br />Report (see Exhibit `B"). <br />ANALYSIS/DISCUSSION: <br />Corporate Yard Fuel Depot USTs were installed in 1989. The City pays annual UST Fuel Taxes to <br />State Board of Equalization and annual UST fees to San Bernardino County Fire Department. In <br />addition, the City also pays annual UST testing to various companies. The City pays approximately <br />$8,000 for all of these fees and taxes annually. <br />
