Important changes in the <br />law have bcem incorporated into youac Local Guidelin.es. For easy reproduction and access to <br />forms, a copy of your Local Guideliaes on computer diskette has been included. <br />This inemorandwn summarizes the changes to the Califomia Environmental <br />Quality Act ("CEQA") from 20()4 to 2005 by expl�ining reguletory and legislative amendments <br />and new court decisions. The �rst s�ction summarizes the 2QU4 amendmcnts to the State CEQA <br />Guidelines. The second section digests the 2004 CEQA legi.slation. The thi�d section analyzes <br />the CEQA decisions that were issued by the courts in the last year. For your convenience, the <br />cases in this sectian are loosely grouped by copic. <br />Your Local Guideiines and this memorandum are designed to assist you in <br />assessing the environmental irnplications of a project prior to its approval, as mandated by <br />CEQA. We still recommend, however, you consult with an attorney when you have specific <br />qucstions aa major, controversial or unusuai projects. <br />Ra�v�sioris �ro � ST,�� +CEQA G�rtn�nvEs <br />_...,....�.. <br />As you will recall, in 2003, the outgoing Davis administration proposed numerous <br />amendments to the State GEQA Guidelines and many other administrative regulations. <br />Govemor SGhwarzenegger put alt of these proposed new regulations, including the State CEQA <br />Guidelines, "on hold" pendir�g review by his staff. <br />After reviewing the proposed changes to the State CEQA Guidelines, the <br />Resources Agency withdrew some of the progosed amendments, revised others, and gave notice <br />that it int�nnded to proceed with some of the proposed revisians. In July 2Q04, th� Resources <br />Agency released a"Final Statement of Reasons for Proposed Guideline Amendme�nts," which <br />listed the proposed amendments, explained them, and includcd the Resource Agcncy's responses <br />to the comments it had received during the rulemaking process. <br />SACRAMENTnV7'B�l T360.1 <br />
