Staff further discussed this change with EPA and was successful in obtaining verbal concurrence from them to utilize the $24,000 balance of funds appropriated for the Phase II assessments on the Regional Park properties for Phase I assessments on properties at the north end of Mt. Vernon across from Valley College. This amendment will entail a minor change to the scope of work and will not affect the MOA, other factors of the SuppoR Agreement, or any funding. The change will redirect funds to be utilized for completing Phase I assessments on 21 parcels: APNs 0160-183-26, 0160-183-25, 0160-183-24, 0160-183-23, 0160-183-22, 0160-183-21, 0160-183-20, 0160-183-19, 0160-183-18, 0160-183-17, 0160-183-16, 0160-183-15, 0160-183-14, 0160-183-13, 0160-183-12, 0160-183-11, 0160-183-10, 0160-183-09,0160-183-08,0160-183-07,and 0160-183-06. It should also be noted that the money will be lost if not used by the grant extension date of March 31, 2005. FINANCIAL IMPACT The COE was paid $94,920 in advance from the EPA Brownfields Grant to COE for completion of Support Agreement No. 2 to the MOA. This amendment will redirect $24,000 of unused funds for Phase II assessments for the Regional Park to competing Phase I assessments for the North Mt. Vernon properties. There will be no additional funding requirements from the City or Agency. ENVIRONMENTAL IMPACT There are no environmental impacts associated with this amendment to the scope of work for Support Agreement No. 3 to the MOA. RECOMMENDATION Staff recommends that City Council and the Agency Board approve Support Agreement No. 3 to the MOA by and between the City of Colton, the Redevelopment Agency for the City of Colton and the United States Army Corps of Engineers which will be in substantiative form as shown in attachment A and authorize the City Manager/Executive Director to execute documents related to such approval, with any non-substantive changes approved by the City Manager/Executive Director, the Redevelopment Director and City Attorney/Agency Counsel.
