R-03-05 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF COLTON DENYING A GENERAL PLAN <br />AMENDMENT, ZONE CHANGE AND TENTATIVE TRACT <br />MAP. 17187 FOR A 25 -LOT SUBDIVISION AND 1 -LETTER <br />LOT FOR OPEN SPACE (FILE INDEX NO. DAP -000-358) <br />FOR PROPERTY LOCATED AT 488 AND 502 WEST <br />JOHNSTON AVENUE <br />WHEREAS, 26 Colton, LLC (the Applicant) filed applications (File No. DAP - <br />000 -358) requesting a general plan amendment to re -designate property from Low Density <br />Residential to Low Density Residential/Planned Community and a zone change to re -zone <br />property from R-1 (Single Family Residential) to R-1/PC (Single Family Residential/Planned <br />Community) and Tentative Tract Map No. 17187 to create a 25 -lot subdivision with 1 -letter lot <br />for open space purposes ("Applications") for property located at 488 and 502 West Johnston <br />Avenue (Assessor Parcel Nos. 0160-111-07 and 08) ("Subject Site"); and <br />WHEREAS, the City of Colton Planning Commission (the "Planning <br />Commission") held public hearings on the Applications on March 22, 2005 and April 12, 2005, <br />after giving published notice of the Applications; and <br />WHEREAS, the Planning Commission has determined that the proposed <br />Applications are not consistent with the goals and policies of the City of Colton General Plan, are <br />not in the best interests of the City's general welfare and the public health and safety, and it <br />would not be in the public interest to recommend approval of the Applications. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />SECTION 1. The Planning Commission of the City of Colton hereby determines <br />that the proposed Applications are not consistent with the goals and policies of the City of Colton <br />General Plan and are not reasonably related to the public welfare of the citizens of the City and <br />the surrounding region for the reasons stated below: <br />A. The intent and purpose of the PC land use designation is to allow for the <br />development of larger pieces of property using non traditional land use and development <br />standards. Larger lot sizes allows for smaller lots to be accommodated in such a way as to permit <br />a natural transition of higher densities to lower densities. In these Applications, the applicant <br />does not allow for the natural transition of larger to smaller lot sizes. <br />B. The Planning Commission finds that the Applications do not keep the same <br />land use pattern as envisioned under the City's General Plan. There are no other smaller lots <br />abutting the Subject Site. <br />C. The Planning Commission finds that the proposed land use and zone <br />change are not consistent with the intent and spirit of the General Plan inasmuch as a hotchpotch <br />of land uses is being created contrary to the orderly development envisioned by the General Plan.. <br />28 II D.
