� <br />. .. .. . . .. . . ... . ,..... ..L .. .. <br />CITY OF COLTON <br />PROFESSIONAL SERVICES AGREEMENT <br />L PARTIES AND DATE. <br />This Agreement is made and entered into this day of , 2005 by <br />and between the City of Colton, a murucipal organization organized under the la�s of the State of <br />California with its principal place of business at 650 North La Cadena Drive, Colton, California <br />92324 ("City") and Michael Brandman Associates, a California Corporation, with its principal <br />place of busi�ess at 621 East Carnegie Drive, Suite 100, San Bernardino, California, 92408 <br />("Consultant"). City and Consultant axe sometirnes individually referned to as "Part�' and <br />eollectively as "Parties." <br />2. RECITALS. <br />2.1 Applicant. <br />Pacific Rai1 Industries (tke "Applicant") previously applied for and received approval from <br />the City of Conditional Use Pernut Number C-5-86 for the development and operation of a Rail <br />Dismantling and Salvage Operations Facility (the "Facility") at 785 East "M" Street. On November <br />16, 2004, the City approved a Modification to the Conditional Use Permit Number C-5-86 for the <br />Applicant to allow a fifty percent increase in transloading activity (transferring goods frorn rail cars <br />to trucks) and the relocation and re-assembly of a steel shredder facility for the shredding of <br />automobiles and other large metal obj ects that will occupy appro�umately 12,000 square feet of 19.39 <br />acres of certain real property used by the ap�licant and iocated within the City at 785 East "M" Street <br />as'an expansion/addition to the previously-approved Facility ("Addition to Facility"). In the appxoval <br />of the modification, the City certified an Bnvironmental Impact Report in compiiance with a11 areas <br />of the California Environmental Quality Act (CEQA) {"Project"). Subsequent to the approval b� the <br />City, on Decernber 2, 2004, Hugo Neu-Proler Company d.b.a. Colton Iron and Metal ("C]M"} a <br />business competitor located across the street from the project site, filed a Writ of Mandate. On <br />October 18, 2005, the court issued its' Statement. of Decision requiring additional environmentai <br />review of certain aspects of the proj eet's traffie, the handling of hazardous materials, and cumulative <br />air quality. The Applicant has requested that the City commence with the additional environmental <br />' work. <br />2.2 Consultant. <br />Consultant desires to perform and assume responsibility for the provision of certain <br />professional .services required by the City on the terms and conditions set forth in this Agreement. <br />Consultant xepresents that it is experienced in providing environmental consulting and <br />documentation services to public clients and is familiar with the Proj:ect. <br />RVPUB�ELC\627843 <br />I ,_ <br />1 <br />(?,LS: OCTOBER 25, 2005) <br />
