R-09-05 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF COLTON RECOMMENDING TO THE COLTON <br />CITY COUNCIL APPROVAL OF A ZONE CHANGE AND <br />ADOPTION OF A NEGATIVE DECLARATION FOR <br />PROPERTY LOCATED AT 744 EAST "G" STREET (FILE <br />INDEX NO. DAP -000-459) <br />WHEREAS, Morgan Hills LLC, a California limited liability company filed an <br />application (File No. DAP -000-459) requesting a zone change to change the zoning designation from <br />C-2 (General Commercial) to R-2 (Duplex Residential) ("Application") for property located at 744 <br />East "G" Street (Assessor Parcel No. 0162-202-31) in the City of Colton, County of San Bernardino <br />("Subject Site"); and <br />WHEREAS, the City of Colton Planning Commission. ("Planning Commission") <br />held a public hearing on the Application on September 13, 2005, after giving published notice of the <br />Application; and <br />WHEREAS, as referenced in the attached Exhibit "A" the Planning Commission has <br />determined that the Application is consistent with the goals and policies of the City of Colton <br />General Plan, is in the best interests of the City's general welfare and the public health and safety, <br />and it would be in the public interest to recommend approval of the Application inasmuch as the R-2 <br />zoning designation would implement the Multi Use land use district goals and policies of the General <br />Plan; <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />SECTION 1. The Planning Commission hereby determines that the Application is <br />consistent with the goals and policies of the City of Colton General Plan and is reasonably related to <br />the public welfare of the citizens of the City and the surrounding region for the reasons set forth in <br />the Application and the attached Exhibit "A". <br />SECTION 2. The Planning Commission also hereby recommends that the City <br />Council change the zoning designation of the Subject Site from C-2 (General Commercial) to R-2 <br />(Duplex Residential) ("Application") for property located at 744 East "G" Street. A copy of the <br />proposed ordinance is attached hereto as Exhibit "A" and is incorporated herein by this reference. <br />SECTION 3. The Planning Commission, in accordance with the California <br />Environmental Quality Act (CEQA), the City of Colton implementing procedures for CEQA and the <br />State CEQA Guidelines, hereby determines that the recommendation and adoption of the proposed <br />ordinance will not have a significant impact on the environment and a Negative Declaration has been <br />prepared. The Planning Commission hereby recommends the City Council adopt a Negative <br />Declaration for this Application. <br />ORANGE\MXM\19705.1 - 1 - <br />
