City Clerk Ramos submitted the Affidavit of Posting and reported that no protests
<br />or objections had been received.
<br />Mr. Wang reported on the alley paving project that had been completed at "E" and
<br />"F" Streets and Pennsylvania Avenue, at a cost of $601.96, stating that the re-
<br />port and cost analysis have been submitted for the project.
<br />Mayor Gonzales asked if anyone desired to speak on this matter.
<br />Moved by Councilman Hayes, seconded by Councilman Rehrer, to terminate the Public
<br />Hearing. Unanimous vote.
<br />Moved by Councilman Rehrer, seconded by Councilwoman Garcia, to approve Resolution
<br />No. 4069. Unanimous vote.

<br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS:
<br />Conditional Use Permits
<br />P. C. Res. No. 979
<br />Planning Director Aguilera reported on a Conditional Use Permit requested by Emblem
<br />Development, Inc., to develop a twenty lot, single family subdivision on approxi-
<br />mately 5.15 acres in Tract No. 10048 located in La Loma Hills, westerly of La Loma
<br />Q Drive. The property is zoned R -1-X, the "X" classification stipulates certain con-
<br />ditions for development.
<br />Mr. Aguilera advised the project is consistent with the General Plan and compatible
<br />with surrounding uses, and adequate utilities, access, facilities, and services are
<br />or can be made available to the site.
<br />Mr. Aguilera stated that the Planning Commission, at a public hearing held January
<br />13, 1981, recommended approval of the Conditional Use Permit application subject
<br />to findings and conditions as outlined in Planning Commission Resolution No. 979.
<br />Mr. Aguilera said he would like to inform the Council that Condition No. 9 was
<br />erroneously included in Resolution No. 979, and that Condition should be removed
<br />from the Resolution.
<br />Councilwoman Garcia asked why this Condition was being removed from the Resolution.
<br />Mr. Aguilera explained that Condition No. 9 pertains to multi -family type of
<br />developments, condominiums, multi -family residences, etc., and would not apply
<br />to this project.
<br />Moved by Councilwoman Garcia, seconded by Councilman Hayes, to approve Planning
<br />Commission Resolution No. 979, together with findings and conditions, with the
<br />stipulation that Condition No. 9 be removed from the Resolution. Unanimous vote.
<br />Zoning

<br />Mr. Aguilera stated this item concerns the City Council's clarifying an ambiguity
<br />and making a determination, or interpretation, of certain sections of the City's
<br />Zoning Ordinance as it pertains to the use of San Hidalgo Institute.
<br />Mr. Aguilera advised that the Planning Commission, on December 23, 1980, adopted
<br />Planning Commission Resolution No. 978, by unanimous vote, requesting that the
<br />City Council make the final determination as to the proper procedures to be pur-
<br />sued in this.matter.
<br />Mr. Aguilera concluded the choices to be determined by the City Council are that
<br />San Hidalgo Institute be a permitted use, as outlined in Section 18.14.010 of the
<br />Colton Municipal Code, or that San Hidalgo Institute be required to obtain a Con-
<br />ditional Use Permit, as outlined in Section 18.30.010 of the Code.
<br />Discussion then followed between Councilman Rehrer and Mr. Juan Jimenez, Attorney
<br />representing the San Hidalgo Institute, with regard to a letter dated January 5,
<br />1981, from the Department of Education stating that San Hidalgo Institute was, in
<br />fact, a school and what type of school.
<br />Mayor Gonzales suggested that this matter be referred back to the Planning Commis-
<br />sion with the recommendation from the City Council for approval of Planning Commis-
<br />sion Resolution No. 978, Item B, Unclassified Use, requiring that the school obtain
<br />a Conditional Use Permit.
