4 to the City Council again before any formal bids for construction work would proceed. <br />Mr. Wang further advised there is a time element involved in order to be eligible for <br />the grade separation funding, which will pay 80 percent of the total construction <br />costs or project costs, and there is a deadline for applying for this funding, there- <br />fore it is most important to get this matter underway as soon as possible. <br />Mr. Wes Hayden, President of the Chamber of Commerce, stated this matter has been <br />before the public's eye for more than 25 years, the underpass is unsafe and has <br />created a hazardous condition by rerouting trucks through the Wilson School district, <br />and he felt it was time that the Council moved on this project. <br />After additional comments, moved by Mayor Gonzales, seconded by Councilwoman Garcia, _ <br />to award contract to Moffit and Nichols for professional engineering design services <br />on the Fogg Street grade separation project. Motion carried, with Councilwoman <br />Cisneros voting NO. <br />Agreements <br />Neste, Brudin & Stone <br />City Manager Trevino reported from his memorandum, and a memorandum from Mr. Wang, <br />regarding the proposed La Cadena Drive improvement project which will consist of <br />pavement widening and resurfacing, curb and gutter installation, sanitary sewer <br />extension and storm drain facilities. <br />Mr. Trevino stated that Staff recommends that the firm of Neste, Brudin & Stone <br />be awarded the contract for professional engineering services on the La Cadena <br />Drive improvement project. <br />Councilman Hayes asked if there were funds budgeted for this project. <br />Mr. Trevino stated that Gas Tax funds would be used for this project. <br />Moved by Councilwoman Garcia, seconded by Councilman Hayes, approving and authorizing <br />award of contract to Neste, Brudin & Stone for professional engineering services on <br />the La Cadena Drive improvement project. Unanimous vote. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />Legal Files <br />Condemnation Proceedings <br />City Attorney Edwards reviewed his memorandum regarding condemnation proceedings <br />against Southern California Edison Company to acquire Edison facilities at Bluffs <br />Restaurant and vicinity on Washington Street, east of the freeway. Mr. Edwards <br />advised that both Edison and City Staff are of the opinion that $43,950 is due <br />Edison as fair compensation for the items being acquired by the City. <br />Mr. Edwards discussed the Stipulation of Facts and as to Value, Case No. 198 827, <br />relating to the condemnation proceedings and two agreements between Edison and <br />the City, one adjusting payment for equipment changes, and the other relating to <br />sales tax liability. Mr.Edwards stated in his opinion, the three documents are <br />reasonable and, if the Council agrees, a motion to authorize their signing would <br />be appropriate. <br />Moved by Councilwoman Garcia, seconded by Councilman Rehrer, to approve and authorize <br />signing of Agreements between Southern California Edison Company and City of Colton <br />relating to condemnation proceedings as outlined by the City Attorney. Unanimous vote. <br />ORAL COMMUNICATIONS: <br />Parade Permits <br />Recreation <br />Mr. Abraham Sanchez, representing the Colton Youth Recreation Group, presented the <br />Mayor and Council Members with a written report requesting permission to conduct <br />a Low and Slow Bike Review on Saturday, January 17, 1981, at 1:00 p. m. <br />Police Chief Phil Elliott stated, after brief discussion with Mr. Sanchez, that the <br />group is requesting a parade permit and use of the parks, and if Council desires to <br />approve the request, subject to ratification by the Chief of Police, he would be <br />happy to work out the details with Mr. Sanchez and the Youth Group. <br />Moved by Mayor Gonzales, seconded by Councilman Hayes, approving Parade Permit and <br />use of Parks, subject to ratification by the Chief of Police, as requested by the <br />Colton Youth Recreation Group for the Low and Slow Bike Review, Saturday, January 17, <br />1981, at 1:00 p. m.
