8(),City Manager Trevino replied that Councilman Rehrer knows quite well the answer to <br />that, if a man goes out and puts in Staff time with an architect and he's authorized <br />a set of plans, and if he is rejected, obviously we are under moral obligation to <br />pay. Mr. Trevino continued that if the Council goes ahead and authorizes Mr. King <br />to proceed and make that expenditure, and if he is rejected, it would seem, morally, <br />the City would recommend payment. Mr. Trevino stated that at least the City is not <br />asking a man to go out and put in time and effort and have a set of plans drawn <br />without some sort payment if he is rejected. Mr. Trevino concluded that should Mr. <br />King's proposal be rejected, he would be paid, and the City would then deal with the <br />next bidder, that is certainly the way it is done. <br />Councilman Rehrer stated that the Council should know all of these things before <br />entering into any negotiations. <br />Moved by Mayor Gonzales, seconded by Councilwoman Garcia, to approve Staff's recom- <br />mendation with regard to proposed Library building. <br />Councilwoman Cisneros stated that before the voting on the motion, she would like to <br />make some comments. Mrs. Cisneros stated she has heard at least twenty questions <br />here this evening that have not been answered, and the most important thing here is <br />that the City Council has the responsibility of the taxpayer's money, and the Council <br />Members are supposed to be responsible people, looking at what is the best for the <br />people of the community, and what is the most we can get for our tax dollar for the <br />City of Colton. <br />Mrs. Cisneros continued that Councilman Rehrer's question was not answered, and she <br />believes that the City has never gone into negotiations without knowing how much the <br />cost will be or what the City will be getting for their money. Mrs. Cisneros said <br />she cannot see why there should be any hurry, this is a big project and the City <br />should take its time, because this is going to cost the City a great deal of money. <br />Mrs. Cisneros stated in talking about proposals, this is the very first time that <br />she has seen the proposal presented by Mr. King, and she did not like the idea of <br />having to vote on something that she has seen for the first time. Mrs. Cisneros <br />said the Council should have been afforded the opportunity of reviewing other pro- <br />posals as well, which is what she had asked at a previous meeting. <br />Councilwoman Cisneros concluded the Council has a responsibility to the taxpayers <br />because they are the ones that will have to pay for it. <br />After additional discussion, Mayor Gonzales asked for a Roll Call Vote on the <br />motion as made: <br />AYES: Three; Hayes, Garcia, Gonzales. <br />NOES: Two; Cisneros, Rehrer. <br />ABSENT: None. <br />Motion carried. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />City Properties <br />City Attorney Edwards advised that previously the Council authorized the sale of <br />excess property owned by the City in the vicinity of Mt. Vernon and Mill, general- <br />ly referred to as "the Hotwell property", and that transaction is now ready to be <br />completed. Mr. Edwards continued in the transaction, the City is acquiring a new <br />easement from the property being retained exiting on Mt. Vernon Avenue, and direc- <br />tion has been given to the title company to issue a policy of title insurance in <br />favor of the City, insuring the City's title to that easement. <br />Mr. Edwards stated the City previously acquired an easement from the property exit- <br />ing on Mill Street; after the close of the transaction, that easement will no longer <br />be needed, and it is proposed that easement be released. <br />Mr. Edwards concluded Staff recommends to proceed with the sale and, if the Council <br />concurs, the following action is suggested: <br />1. <br />2. <br />3. <br />JUL 2 11981 <br />Authorize execution of a quit claim deed to release the existing easement of <br />the City exiting on Mill Street. <br />Authorize acceptance of the deed to the City granting the new easement exit- <br />ing on Mt.
