10 4councilwoman Garcia asked where this committee originated from, and how it came
<br />about.
<br />Mr. Wes Hayden, 279 West Litton, Colton, Chairman of the Colton Western Days Com-
<br />mittee, stated the committee was formed by concerned citizens to carry on an annual
<br />event in our City, and the funds that are received from the event will be placed in
<br />a fund and left over, for no particular association, other than the Firemen's Associa-
<br />tion, who is sponsoring the rodeo itself, and remaining funds will be placed in a
<br />local bank to carry forward for next year, and the Committee will have monies to
<br />live on, to carry on the event next year, and each year thereafter.
<br />Councilwoman Garcia asked if the Western Days Committee is a chartered committee,
<br />affiliated with the City, or where did it originate from.
<br />Mr. Hayden explained that the Colton Western Days originated with the Chamber of
<br />Commerce, however, when they could no longer fund this event, due to a lack of
<br />sufficient monies, a group of concerned citizens did not want to see this event
<br />die, and therefore, the original committee decided to carry it on. Mr. Hayden
<br />said eventually the committee will need to file for a charter, and also with the
<br />IRS to obtain a non-profit organization status.
<br />Councilman Rehrer asked about their liability insurance.
<br />Mr. Hayden stated the liability insurance is handled by George Knight Insurance,
<br />which is the IRA National Rodeo Association and covers insurance yearly, through-
<br />out the rodeo circuit, therefore the liability insurance covers the date of the
<br />first event through the date of the final event.
<br />Councilman Rehrer then asked if there will be a parade connected with this event.
<br />Mr. Hayden answered that the parade will be for the Colton Invitational Band Review,
<br />another yearly event, which will be held on October 25, 1981, however, due to a lack
<br />of funds, there will not be an actual Western Days parade.
<br />Councilwoman Garcia stated she would like to ask the City Attorney if the City is
<br />not setting a precedent by allowing this committee, which is not a City -formed com-
<br />mittee or Chamber of Commerce function, but a group of concerned citizens, to post
<br />banners, waive fees, etc., and should the Council be approached by another committee,
<br />her concern was that the City Council may be setting a precedent at this time by
<br />allowing this committee to do this.
<br />City Attonrey Edwards responded the answer would probably be yes, however, the City
<br />does have a Business License Ordinance that already exempts charitable organizations
<br />and businesses that have an annual gross of under $1,000.
<br />Discussion then followed among Councilwoman Garcia, Councilman Rehrer and Mr. Hayden
<br />with regard to the placement of posters on utility poles, the Colton Western Days
<br />Committee, and possible future committees or organizations that may have similar re-
<br />quests.
<br />Mayor Gonzales asked for a vote on the motion as made, which was unanimously approved.
<br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS:
<br />Ordinance No. 1608
<br />City Attorney Edwards reported from his memorandum with regard to consideration of
<br />an amendment to certain sections of the City's Ordinance No. 1326, requiring rabies
<br />vaccination for license issuance. Mr. Edwards advised that the amendment would pro-
<br />vide that no rabies vaccination is required if a veterinarian certifies it might be
<br />fatal to the animal due to its physical condition.
<br />Mr. Edwards continued this matter was brought about by a request from Mr. Art Gray,
<br />who is present this evening and wishes to address the Council Members, as his dog
<br />had previously reacted poorly to a rabies vaccination, is in poor health, and a
<br />local veterinarian has stated another rabies vaccination may cause death to the
<br />dog.
<br />Mr. Edwards concluded if the Council Members are in agreement with the report and
<br />the information as submitted, it would be in order to consider Ordinance No. 1608,
<br />which is an emergency ordinance and would be effective immediately. Mr. Edwards
<br />asked if the Council wished to have the ordinance read in full, or waive full
<br />reading.
<br />Moved by Councilman Hayes, seconded by.Councilwoman Garcia, to waive full reading
<br />of Ordinance No. 1608. Unanimous vote.
