Bids <br />19N <br />Mr. Elliott reported on a project time schedule for pretreatment program laboratory <br />services, advising that the City applied for and received a grant for the develop- <br />ment of a pretreatment program, which program will consist of reviewing the indus- <br />trial discharges and determining the effect of the discharges on the treatment plant. <br />Mr. Elliott concluded as part of this program, a laboratory service contract is <br />required in order to obtain the services of a laboratory to perform analysis and <br />collect samples. <br />Mr. Steve Herrera, representing Kreiger & Stewart, advised that the grant will <br />cover 87%% of the costs, and 122% of the costs will be paid by the City, which <br />will amount to $5,100. Mr. Herrera also advised that these samples and tests <br />are required by Federal law and the Water Quality Control Board. <br />Councilwoman Cisneros stated that she would like a copy of the sewer plant Contract <br />and she would like to know just what they are responsible for. <br />After additional discussion, moved by Councilwoman Garcia, seconded by Councilman <br />Rehrer, approving and authorizing the call for bids on Pretreatment Program Labor- <br />atory Services. Unanimous vote. <br />Cemetery <br />Mr. Elliott referred to a letter received from the Cemetery Board in Sacramento, in- <br />dicating that because of complaints they have received with regard to the unlicensed <br />sales activities of Mrs. Jennie Gonzales at Hermosa Cemetery, the City of Colton must <br />make a decision regarding the status of Mrs. Gonzales. Mr. Elliott also referred to <br />a letter from Mr. Dan E. Qualls, Attorney at Law, which indicated the City of Colton <br />may be in possible violation of Section 8137 of the Health and Safety Code, because <br />Mrs. Gonzales receives a commission for the sale of monuments or markers at a ceme- <br />tery owned and operated by the City. <br />Mr. Elliott said the Cemetery Board has indicated the City of Colton has two options - <br />make Mrs. Gonzales an employee of the City of Colton; or, terminate her sales activi- <br />ties on behalf of Hermosa Cemetery. <br />Moved by Councilwoman Garcia, seconded by Councilman Rehrer, to refer this matter to <br />the Cemetery Commission for review. Unanimous vote. <br />Cemetery <br />Res. No. 4207 <br />Mr. Elliott recommended approval of Resolution No. 4207, transferring funds within <br />the Cemetery budget for the purchase of a new trimmer to replace the existing trimmer <br />that is less efficient. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, to approve Resolution <br />No. 4207. Unanimous vote. <br />RESOLUTION NO. 4207 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON AMENDING <br />THE 1981-82 FISCAL YEAR BUDGET. <br />Cemetery <br />Mr. Elliott reported on a request from the Cemetery Commission for the placement of <br />posts and cables at the entrances of Hermosa Cemetery in order to deter vandalism. <br />Planning Director Aguilera advised the Cemetery Commission is very concerned about <br />the high rate of vandalism that has been occurring at Hermosa Cemetery at night, <br />and the Commission feels that if posts were erected at the entrances, with heavy <br />chains in between, it would eliminate the vehicles from entering the cemetery at — <br />night. <br />After discussion, moved by Councilman Rios, seconded by Councilman Rehrer, to con- <br />tinue this matter to the next regular meeting, June 1, 1982. Unanimous vote. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />Fees <br />City Attorney Edwards reported on a refund of a fee in the amount of $200. to Vern <br />Schafer for a Variance application to install a sign. <br />Mr. Edwards advised that because Mr. Schafer had obtained a Building Permit for the <br />sign, and had already purchased the sign, Staff felt it would be unfair for the <br />m�Yn 1oa? <br />
