36S <br />applicant submits his development plans. <br />Councilwoman Garcia then expressed her concern for the additional <br />traffic this proposed project would create and she stated she felt <br />that an EIR should be required now. Mrs. Garcia said it is still a <br />matter of putting the cart before the horse, and when is the City <br />going to start doing things right. <br />Mayor Huntoon asked if the Council were to go ahead and approve the <br />General Plan Amendment and the Zone Change this evening so that the <br />applicant could proceed with development plans, reports, etc., and _ <br />all the other things that had to be done, the applicant would still <br />have to prepare an EIR on this project, is that right. <br />Mr. Aguilera stated that was correct. <br />Councilman Rios asked if this matter could be approved subject to <br />the results of an EIR. <br />Mr. Aguilera answered no, zone changes cannot be approved condition- <br />ally. <br />Councilman Rios then asked if the City Council were to go ahead and <br />approve this, what control would the City then have over the devel- <br />opment later on, once the EIR was done on the traffic. <br />Mr. Aguilera stated the control would then lie with the Planning Com- <br />mission when they review the EIR. Once the applicant has filed his <br />development plans, the City would then require an EIR, which would be <br />reviewed by the Planning Commission and certain conditions on the de- <br />velopment would be made. <br />Councilwoman Garcia stated she was in agreement with the Planning Com- <br />mission, in that an EIR should be required at this time, on the zone <br />amendment, to take care of the concerns of the additional traffic and <br />other problems that would be created. -- <br />Mr. Bonadiman again addressed the City Council saying that until the <br />development plans are prepared and submitted it is not really known <br />what problems might be encountered, and at that point Staff would then <br />require a focused EIR, which would indicate what is needed and what <br />can be mitigated. Mr. Bonadiman said at that point the City can <br />decide whether or not they want the project, however, in order to <br />get things moving, the rezoning is needed first. <br />Councilwoman Garcia said she felt that this whole matter was being <br />"steamrolled" through and she felt it could wait until September 6th <br />when the City could take a better look at the whole matter. Mrs. <br />Garcia said the Council should take into consideration the comments <br />that are being made by the residents of Reche Canyon, and think about <br />some of the serious problems that could be created by these develop- <br />ments. <br />Councilwoman Garcia moved that the City postpone this matter until <br />September 6, 1983. Motion died for lack of a second. <br />Councilman Rios then moved for approval of the Zone Change. Motion <br />seconded by Councilman Rehrer. <br />City Attorney Edwards then explained that the item before the City <br />Council is the matter of the Appeal, and, if the Council desires, a <br />motion to grant the Appeal, which would be to give a Negative Declara- <br />tion, would be proper. Following that, the City Council can consider <br />Item No. 16, the General Plan Amendment, and Item No. 17, the Zone <br />Change, which involve Public Hearings, and take action on those items <br />after the Public Hearings. However, the action at this time would be <br />on Item 21, and a motion to sustain the Appeal and grant a Negative <br />Declaration. <br />Councilman Rios withdrew his motion and Councilman Rehrer withdrew his <br />second to the motion. <br />After additional discussion, moved by Councilman Rios, seconded by <br />Councilman Rehrer, to sustain the Appeal and grant the Negative Dec - <br />AUG Ii 1983 <br />
