Mr. Aguilera advised that at this point, there is nothing that the City can do, be - <br />27 8 cause the General Plan, which was approved and adopted by the City Council, does <br />designate this area as agricultural and State law prohibits the zoning of property <br />that is contrary to what is stated in a General Plan. Mr. Aguilera said the <br />General Plan can be amended at a later date, however, at this point it would have <br />to remain as is. <br />Discussion then followed among Council Members and Staff with regard to the exist- <br />ing General Plan designation and the prezoning designation as recommended, wherein <br />Councilwoman Garcia and Councilmen Rehrer and Rios felt the Council should abide by <br />the existing General Plan and Staff's recommendations at this point, and later amend <br />the General Plan; Mayor Huntoon and Councilwoman Cisneros felt the prezoning should <br />now be changed to industrial. <br />Moved by Councilman Rios, seconded by Councilwoman Garcia, the Public Hearing was <br />terminated. Unanimous vote. <br />Moved by Councilwoman Garcia, seconded by Councilman Rios, to waive full reading and <br />pass First Reading of Ordinance No. 1634. Unanimous vote. <br />ORDINANCE NO. 1634 - AN ORDINANCE OF THE CITY OF COLTON AMENDING ORDINANCE NO. 1602, <br />First Reading AS AMENDED, AND PROVIDING FOR CERTAIN ZONE RECLASSIFICATIONS. <br />Discussion then followed with regard to the General Plan as it now reads and possible <br />future review. <br />Moved by Councilman Rios, seconded by Councilwoman Cisneros, to initiate a General <br />Plan review of the property in question owned by Mr. Singletary. <br />Councilman Rehrer asked if this review pertained to the entire General Plan, or just <br />the area discussed this evening. <br />Councilman Rios responded that he was talking about Mr. Singletary's property. <br />Councilwoman Garcia then asked if the other properties surrounding Mr. Singletary <br />would also be included in this review, or other areas of the General Plan, because <br />she felt if the Council was going to make a review of the General Plan, it should <br />be done in its entirity, and not "piece meal". Mrs. Garcia felt this matter should <br />be turned over to Staff and let them come back with a recommendation. <br />Councilman Rehrer stated that he was in agreement with Councilwoman Garcia because <br />there are probably other property owners in the City with a similar problem, and <br />this should be handled by Staff. <br />Planning and Building Director Aguilera stated the area in question is south of <br />Agua Mansa Road and east of Riverside Avenue, the properties along this area, both <br />in the City and in the sphere of influence of the City and, in keeping with Council- <br />man Rios' motion, Staff would have to look at surrounding properties as a matter of <br />course because we cannot create spot zoning or spot General Plan designation. Mr. <br />Aguilera said he agrees with the concept, that the City should review that area, <br />and Staff needs direction from the Council to review the area south of Agua Mansa <br />Road and east of Riverside Avenue. <br />Councilman Rios stated he would include this in his motion, and Councilwoman Cisneros <br />stated she was in agreement, for the second. <br />Mayor Huntoon then asked for a Roll Call Vote on the motion, which was as follows: <br />AYES: Three; Rios, Cisneros, Huntoon. <br />NOES: Two; Rehrer, Garcia. <br />ABSENT: None. <br />Motion carried. <br />City Attorney Edwards asked if it was Council's intent to then refund the fees <br />to Mr. Singletary and, if so, Staff would need direction in this regard. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, authorizing and ap- <br />proving refund of fees to Mr. Gaylor W. Singletary for application of General Plan <br />Amendment.
