No. 1059 <br />Mayor Huntoon declared the Public Hearing open. <br />277 <br />Deputy City Clerk Veralrud submitted the Affidavit of Publication and reported that <br />no protests or objections had been received. <br />Planning and Building Director Aguilera stated that the applicant, Gaylor W. <br />Singletary, has requested the Local Agency Formation Commission begin annexation <br />proceedings for his property located on the east side of Riverside Avenue, ap- <br />proximately 700 feet south of Agua Mansa Road, in San Bernardino County. The <br />L.A.F.C. has initiated proceedings and the City Council has taken the preliminary <br />steps to annex said property, however, before this parcel can be annexed, the <br />City must designate a proper zoning for the property. <br />Mr. Aguilera continued since the property is in the sphere of influence of the City <br />of Colton, the General Plan had previously designated a land use of Agricultural <br />for the area and due to this designation, Staff and the Planning Commission have <br />agreed with the intent of the General Plan and propose a zoning classification of <br />Agricultural for the property. <br />Mr. Aguilera concluded if Council concurs, Staff would recommend introduction and <br />First Reading of Ordinance No. 1634. <br />NMayor Huntoon asked if anyone present desired to speak on this matter. <br />The applicant, Mr. Gaylor W. Singletary, stated that although he is desirous of <br />being annexed to the City of Colton, he is also interested in retaining the In- <br />dustrial zoning designation that the property now has. Mr. Singletary said this <br />Q land is mainly for industrial use and is surrounded by industrial zoning from <br />both the County of San Bernardino and the City of Rialto. Mr. Singletary stated <br />the proposed Agricultural designation would not benefit his property or that of <br />the adjacent property owners, such as Canale Foods. Mr. Singletary said he under- <br />stands that the City's General Plan indicates an Agricultural zone for that area, <br />however, he felt this should be changed as an Agricultural designation would not <br />benefit anyone in the immediate area, and the land should be for industrial use. <br />Mr. Singletary advised that he has already paid the required fees to the L.A.F.C., <br />which of course could not be refunded at this point, however, he would definitely <br />like to see industrial zoning for that area and his property. <br />Mr. Aguilera then explained that approximately 600 acres of land, south of Agua <br />Mansa Road to the County line, located in the County of San Bernardino, is zoned <br />for industrial use and indicated in the General Plan as industrial; however, ap- <br />proximately one year ago, the new General Plan was adopted and it called for Ag- <br />ricultural zoning for that area. Mr. Aguilera said with the property now being <br />annexed, the City is obligated to zone this property Agricultural to coincide with <br />the General Plan designation for that area. <br />Mr. Aguilera continued that he had explained to Mr. Singletary the way to change <br />the designation would be to file for a General Plan Amendment, which Mr. Singletary <br />has now done. Mr. Aguilera advised that the next General Plan Amendment will be <br />processed in April of this year and will be brought before the City Council for con- <br />sideration and if the Council approves the amendment, the property will be changed <br />to industrial zoning. Mr. Aguilera said that unfortunately it cannot be changed at <br />this point, the annexation proceedings have already been initiated and unless Mr. <br />Singletary wishes to stop the annexation, Staff would recommend the City Council <br />proceed with the prezoning of this property to Agricultural, and then amend it at <br />a later date to industrial. <br />Mr. Aguilera pointed out that when Staff takes a look at the General Plan Amendment <br />applied for by Mr. Singletary, they will also take a look at surrounding areas, as <br />^- Staff would not want to create an industrial designation within a pocket of agricul- <br />tural, therefore, Staff will be looking at the surrounding areas, all the way up to <br />Agua Mansa Road and south to Riverside Avenue. <br />Mayor Huntoon stated he was familiar with this area, and he could not understand how <br />anyone could place an agricultural designation on this land, it does not seem logical <br />or fair, especially when the City is attempting to get some industry in Colton and <br />help provide jobs. <br />Mr. Aguilera then pointed out that the City could initiate its own review of the <br />project, and in that way it would not be at the expense of the property owners, <br />and Mr. Singletary would be eligible for a refund on his application. <br />Mayor Huntoon said he does feel this is an unfair situation and, at this point, what <br />can the City do. <br />..1„"--198: <br />
