37(; <br />City Clerk Ramos submitted the Affidavit of Publication and reported <br />that no protests or objections had been received. <br />Community Services Director Joseph McGee reported on construction of <br />alley paving between "B" and "C" Streets and 10th and 11th Streets, <br />as petitioned by the adjacent residents. <br />Mr. McGee advised that all of the required notices have been sent out <br />to the affected property owners, and the formal affidavit certifying <br />to that effect has been signed and submitted to the City Clerk for the <br />official records. <br />Mr. McGee concluded Staff recommends approval of Resolution No. 4367, <br />ordering construction of the alley. <br />Mayor Huntoon asked if anyone desired to speak on this matter. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, the <br />Public Hearing was terminated. Unanimous vote. <br />RESOLUTION NO. 4367 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, MAKING FINDINGS, OVERRULING <br />PROTESTS AND OBJECTIONS AND ORDERING THE CON- <br />STRUCTION OF CERTAIN IMPROVEMENTS PURSUANT TO <br />SECTION 5870, ET SEQ., OF THE STREETS AND HIGH- <br />WAYS CODE OF THE STATE OF CALIFORNIA. <br />Special Assessments <br />Res. No. 4368 <br />Mayor Huntoon declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and reported <br />that no protests or objections had been received. <br />Community Services Director Joseph McGee reported on the formation of <br />the City of Colton's Landscaping and Lighting Maintenance District <br />No. 1, and gave a brief summary of the Engineer's Report, stating <br />the Report outlines the methods of calculating benefits to property <br />owners within the District. The District provides for a public park <br />and landscaped parkways which will be maintained by the property own- <br />ers who benefit from these areas. It also provides for the street <br />lighting throughout the District, with the maintenance and operation <br />of these lights to be paid for by the citizens within the District. <br />Mr. McGee concluded Staff recommends approval of the Engineer's Re- <br />port and Resolution No. 4368. <br />Mayor Huntoon asked if anyone present desired to speak on this matter. <br />Mr. Jack Cook, 844 Edgehill Drive, Colton, stated that when this item <br />was reviewed by the Planning Commission, he understood that the park <br />was a trade-off for a well site on the property, and then asked if <br />thare: was in fact a park within the development. <br />Mr. McGee answered yes, there was a park, and there was also a well <br />site. <br />Councilman Rios asked if there were discrepancies between the Planning <br />Commission information and what was being presented here. <br />Planning Director Aguilera advised that initially there was one park <br />planned and three smaller parks also, however, in lieu of the three <br />smaller parks, it was determined the well site was necessary, and <br />it was further decided to form the assessment district for these im- <br />provements rather than an association of the owners within the park. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, the Pub- <br />lic Hearing was terminated.
