<br />Request permission to advertise for Bids for Annual Weed
<br />Abatement, Project 4184-3, and set Public Hearing date of
<br />April 3, 1984, RESOLUTION NO. 4414.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, to ap-
<br />prove the Consent Calendar as modified. Unanimous vote.
<br />CORRESPONDENCE:
<br />Assessment District No. 79-1
<br />City Attorney Edwards referred to correspondence from Matt Kurilich
<br />which related to the review of Claims for Assessment District No.
<br />79-1. Mr. Edwards advised that Staff was recommending John Brown,
<br />of Best, Best & Krieger, be employed to advise the Council with re-
<br />gard to the validity of Claims made on Assessment District No. 79-1,
<br />and the fees for Mr. Brown's services would be proper charges against
<br />the District, with no cost to the General Fund.
<br />Q Mr. Edwards stated that Mr. Kurilich was present this evening and
<br />Q might want to address the City Council.
<br />Mr. Matt Kurilich, 919 Bayside Drive, Newport Beach, advised the City
<br />Council that he had hired a contractor to begin work on the property
<br />within the District, and thanked Councilman Rehrer for attending the
<br />ground breaking ceremonies. Mr. Kurilich said he was pleased to know
<br />that Mr. Brown would be reviewing the matter of the Claims, and he
<br />would be happy to work with Mr. Brown, if needed.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, authoriz-
<br />ing the employment of John Brown, Attorney for Best, Best & Krieger,
<br />for services on behalf of Assessment District No. 79-1, to review and
<br />advise on the payment of Claims from District funds. Unanimous vote.
<br />Cemetery
<br />City Attorney Edwards read a letter dated February 7, 1984, from Dean
<br />Carter, Cemetery Commissioner, with regard to the condition and opera-
<br />tion of Hermosa Cemetery, and the City in general, stating the City
<br />will never get out of the sub -standard condition it is in until quali-
<br />fied staff makes a study and necessary changes.
<br />Moved by Mayor Huntoon, seconded by Councilman Rehrer, to refer this
<br />matter to Staff and report back to the Council at the next regular
<br />meeting. Unanimous vote.
<br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS:
<br />Assessment District No. 79-1
<br />Director of Community Services Joe McGee reported from his memorandum
<br />regarding Contract Change Order No. 1, from Berryman & Stephenson,
<br />Inc., to provide off-site excavation and embankment for the installa-
<br />tion of an off-site water line. This will increase the contract cost
<br />by $19,900, for a total cost of $1,770,681.60, which is covered by
<br />contingency funds, and will extend the contract period 13 calendar
<br />days, for a total adjusted contract period of 193 days and a comple-
<br />tion date of June 19, 1984.
<br />Mr. McGee concluded Staff recommends approval of the Contract Change
<br />Order No. 1, adding off-site earth work amounts and extending the
<br />time of the contract.
<br />Moved by Councilman Rehrer, seconded by Councilman Rios, to approve
<br />Staff's recommendation with regard to Contract Change Order No. 1
<br />for Assessment District No. 79-1. Unanimous vote.
