Fireworks Sales <br />City Manager Benest advised that Staff is in the process of studying the <br />annual fireworks sales permits and ordinance, and will make a presenta- <br />tion at the next Council Meeting, February 16, 1988. Mr. Benest said <br />Staff will also introduce an ordinance at the first Council Meeting in <br />March on this matter. <br />Pastor Ted David, of the United Pentecostal Church, said he wanted to <br />speak to the Council on this matter, however, he would reserve his com- <br />ments until the next meeting. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />Closed Session <br />City Manager Benest stated the Closed Session would not be necessary and <br />can be removed from the Agenda. <br />Wastewater Treatment Facility <br />City Manager Benest summarized a report prepared by Assistant City <br />Manager Leslie Keane regarding the City's Wastewater Treatment facility <br />which outlined various important issues, including compliance with state <br />and federal laws, residential uses of the system, remaining capacity, <br />future needs, etc. <br />Mr. Benest stated that in the months of November, December, and early <br />January, there were inconsistencies in flow records, which were consis- <br />tently high, and at some points reached the plant's capacity. Mr. Benest <br />then outlined the possibilities for this situation. <br />Mr. Benest continued on January 29, 1988, the Mayor and Staff met with <br />representatives from the development community to discuss the sewer <br />capacity situation, outlining the current problem and identifying three <br />possible alternatives. Mr. Benest then reviewed the alternatives. <br />Mr. Benest said developers at the meeting agreed to a voluntary slow <br />down in development for the next thirty days. Since the City is unable <br />to certify, as required by the Subdivision Map Act, that there is ade- <br />quate sewer capacity for new development, the City will also not be <br />able to process new tentative tract maps during this period. Staff <br />agreed at the meeting, however, to proceed with processing final maps <br />and with plan checking. <br />Mr. Benest concluded given the apparent cooperation of the development <br />community with respect to a short term residential development slow <br />down, and given the current uncertainty about the continuation of <br />capacity sewer flow into the Colton wastewater treatment plant, Staff <br />is not recommending a moratorium on building permits at this time. Staff <br />is, however, requesting the allocation of one million dollars from the <br />Sewer Fund balance and authorization for Staff to proceed with design <br />3 <br />
