Unanimous vote. <br />Ms. Keane then presented Resolution No. R-105-88 for Council's considera- <br />tion and approval, establishing fees for Drainage Benefit Area No. 2. <br />Moved by Councilman Rios, seconded by Councilwoman Garcia, to adopt Reso- <br />lution No. R-105-88. Unanimous vote. <br />RESOLUTION NO. R-105-88 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON ESTABLISHING STORM DRAIN FACILITIES FEES <br />FOR DRAINAGE BENEFIT AREA NO. 2. <br />Drainage Area No. 1 <br />Assistant City Manager Keane reported on Drainage Benefit Area No. 1, <br />which is located in San Bernardino County Flood Control Drainage Area 3-5, <br />containing 277 acres within the City of Colton. The remaining land is in <br />the City and County of San Bernardino. <br />Ms. Keane continued the cost to construct the required drainage facilities <br />will be approximately $7.6 million, and a majority of the facilities will <br />be located within the boundaries of Colton. Ms. Keane said if the cost of <br />the proposed drainage system was spread to all of the currently undevelop- <br />ed acres in 3-5, it would be approximately $8,840 per acre; if, however, <br />the City and County of San Bernardino decline to participate in the <br />project, the cost to property located in Colton will be $29,107 per acre. <br />Ms. Keane advised that although Staff proposes to approach the City and <br />County of San Bernardino with a plan for a coordinated effort, our initial <br />fee must be set at an amount which assumes Colton funding for the entire <br />system. If either or both jurisdictions participate in the system, our <br />fees can be adjusted and any excess monies collected reimbursed to the <br />property owners. <br />Ms. Keane concluded Staff recommends passing Second Reading and adoption <br />of Ordinance No. 0-27-88, adoption of Resolution No. R-106-88 establishing <br />fees, and adoption of an Urgency Ordinance, No. 0-31-88, allowing the <br />City to collect the required fees and to initiate negotiations with the <br />City and County of San Bernardino for their participation in the project. <br />Moved by Councilwoman Cisneros, seconded by Councilwoman Garcia, to pass <br />Second Reading and adopt Ordinance No. 0-27-88.
