Ms. Keane stated if, at the end of the hearing, Council desires to <br />continue with eminent domain proceedings, and if owners decline the <br />City's offer to purchase, the courts will determine the fair market <br />value of the individual parcels. Acquisition of these twelve parcels <br />will provide the City with the most cost effective method of <br />providing required recreational and drainage facilities. <br />Ms. Keane concluded after the close of the public hearing, Staff <br />recommends adoption of nine Resolutions, Nos. R-87-88 through R-95-88. <br />City Clerk Ramos referred to letters received from Arthur R. and <br />Reginald D. Felce; Shirley Marsala; Steve Polopolus and Karen <br />Featherstone; and James W. Anderson, of Brunick & Pyle, on behalf of <br />Ted and Betty Brobeck. <br />Mayor Gonzales stated that all those desiring to speak on this matter <br />may now do so. <br />Mr. James W. Anderson, Brunick & Pyle, 1839 Commercenter West, San <br />Bernardino, stated he was speaking on behalf of Ted and Betty <br />Brobeck, advising the property owners do not wish to get into <br />litigation on this matter and would rather reach some agreement on <br />the amount for sale of their property. Mr. Anderson questioned the <br />appraisals made on these properties and said there was no filing of <br />a Negative Declaration or EIR, and he also questioned the barricading <br />of Woodpine and Indigo Streets. <br />Mrs. Shirley Marsala, 831-6 East Third Avenue, Escondido, and Ms. <br />Karen Featherstone, also addressed the City Council stating that <br />neither felt the fair market value offer from the City was an <br />equitable amount for their properties. <br />Attorney David Cosgrove responded to comments made by Mr. Anderson, <br />stating the City furnished a summary of the basis for the amount <br />offered for the property in question, and the City commissioned a <br />preliminary appraisal of the property by a professional MAI real <br />estate appraiser. Mr. Cosgrove stated keep in mind we are talking <br />about totally undeveloped land. Mr. Cosgrove said he was not aware <br />of the barricading of Woodpine and Indigo Streets, however, he would <br />attempt to make this information available to Mr. Anderson. <br />There being no further comments or discussion, moved by Councilman <br />Rios, seconded by Councilwoman Garcia, to close the Public Hearing. <br />Unanimous vote. <br />Moved by Councilman Rios, seconded by Councilwoman Garcia, to approve <br />and adopt Resolution Nos.
