CONVENIENCE, AND NECESSITY <br />REQUIRE THE ACQUISITION OF <br />-- CERTAIN REAL PROPERTY. <br />Exhibit "A", as referred to in these Resolutions, pertains to <br />Assessor's Parcel Nos. 254-061-149 254-061-159 254-061-1631 <br />254-061-1729 254-061-135 254-061-109 254-061-09, 254-061-05 and <br />254-061-06 respectively. <br />PUBLIC HEARINGS: <br />Eucalyptus Avenue Storm Drain District <br />Mayor Gonzales declared the Public Hearing open. <br />Assistant City Manager Keane submitted the Affidavit of Publication <br />and reported that no protests or objections had been received. <br />Assistant City Manager Keane reported on the formation of a fee <br />district to assist in the payment of storm drain facilities for the <br />Eucalyptus Avenue Storm Drain Project, as outlined in the proceedings <br />for Community Facilities District No. 87-1. <br />Ms. Keane continued the proposed impact fee is based on a straight <br />per acre fee, and assumes that all properties, after being graded per <br />City requirements, will share equally in the cost and the benefit of <br />the required facilities. The current fee is proposed to be $9,414. <br />This, or the final fee, would be set by Resolution and would be <br />reviewed from time to time and adjusted if necessary. The cost of <br />the required improvements will be approximately $1,170,246. The City <br />proposes to waive the upfront impact fee for those properties which <br />currently are, or become a part of, Community Facilities District No. <br />87-1. <br />Ms. Keane stated approval of the proposed fee district will provide <br />funds to reimburse Community Facilities District No. 87-1 for public <br />improvements which benefit properties outside its boundaries, <br />consistent with Council's previous actions forming the district. The <br />proposed ordinance will allow Council to set appropriate fees, by <br />resolution, each year. <br />Ms. Keane concluded at the close of the public hearing, Staff <br />recommends adoption of Resolution No. R-96-88, and First Reading of <br />Ordinance No. 0-26-88. <br />Mayor Gonzales asked if anyone present desired to speak on this <br />matter. <br />Moved by Councilman Rios, seconded by Councilwoman Garcia, to close <br />the Public Hearing. Unanimous vote. <br />Moved by Councilwoman Cisneros, seconded by Councilwoman Garcia, to <br />approve Resolution No. R-96-88. Unanimous vote. <br />RESOLUTION NO.
