OF COLTON DETERMINING THE CONFORMITY OF THE <br />CITY'S VALLEY AND EUCALYPTUS STORM DRAIN <br />PLAN WITH THE DRAINAGE GENERAL PLAN FOR THE <br />COUNTY OF SAN BERNARDINO. <br />Moved by Councilwoman Cisneros, seconded by Councilwoman Garcia, to <br />pass First Reading and waive full reading of Ordinance No. 0-26-88. <br />Unanimous vote. <br />ORDINANCE NO. 0-26-88 - AN ORDINANCE OF THE CITY OF COLTON ADDING <br />(First Reading) CHAPTER 12.36 TO THE COLTON MUNICIPAL CODE <br />RELATING TO THE LEVY OF STORM DRAIN FEES FOR <br />DRAINAGE BENEFIT AREA NO. 2. <br />Storm Drain Fee District <br />Mayor Gonzales declared the Public Hearing open. <br />Assistant City Manager Keane submitted the Affidavit of Publication <br />and reported that no protests or objections had been received. <br />Mr. Keane reported on the formation of Project 3-5 Storm Drain Fee <br />District, advising the San Bernardino County Flood Control District <br />has established drainage area 3-5 located between the Southern <br />Pacific Railway and Eucalyptus Avenue, Mill Street and the Santa Ana <br />River, containing approximately 2,280 acres, 850 of which remain <br />undeveloped. The property is approximately 35% in the City of <br />Colton, 41% in the City of San Bernardino, and 24% in the County of <br />San Bernardino. A majority of the undeveloped _land is in the City of <br />Colton and the County. Although much of the flood water originates <br />in the City of San Bernardino, the flooding problem is located in the <br />City of Colton and the County. Further development in this portion <br />of Colton is not possible until there is a resolution to the flooding <br />problem. <br />Ms. Keane spoke about studies conducted by the Flood Control District <br />to determine the most comprehensive alignment for the required <br />drainage system, and the estimated per acres costs involved. <br />Ms. Keane stated approval of the proposed fee district will allow the <br />City to enter into negotiations with those other jurisdictions <br />involved in Drainage Area 3-5, and with developers who propose <br />construction projects prior to completion of the permanent drainage <br />system for this area. A proposed ordinance will allow Council to set <br />appropriate fees, by resolution, each year. <br />Ms. Keane concluded at the close of the public hearing, Staff would <br />recommend approval of Resolution No. R-97-88, and First Reading of <br />Ordinance No. 0-27-88. <br />Mayor Gonzales asked if anyone present desired to speak on this <br />matter. 6 <br />
