Discussion followed among Councilmembers, Staff and the opponents. <br />Moved by Councilman Roman, seconded by Councilman Rehrer, to close the <br />Public Hearing. Unanimous vote. <br />Councilman Lofy stated that due to the controversy and comments from <br />the residents this evening, he would recommend this matter be returned <br />to the Planning Commission for additional review. Councilman Lofy also <br />recommended that Staff look into the legal ramifications on this matter <br />and obtain a legal opinion before returning this item to the Planning <br />Commission. <br />After discussion, moved by Councilman Lofy, seconded by Councilman Roman, <br />instructing Staff to obtain a legal opinion on possible legal ramifica- <br />tions regarding the Kencor Corporation project, and then refer it to the <br />Planning Commission for additional review. Unanimous vote. <br />Appeal <br />Wyatt Construction <br />Mayor Gonzales declared the Public Hearing open. <br />Deputy City Clerk Veralrud submitted the Affidavit of Publication and <br />reported that no protests or objections had been received. <br />Community Development Director Aguilera reported on an Appeal filed by <br />Wyatt Construction on the Planning Commission denial of File Index No. <br />DT -64-90, Tentative Tract 15102. <br />Mr. Aguilera advised the applicant requested approval of a subdivision, <br />located at 250 Mill Street and south to Hunter Road, consisting of ap- <br />proximately 2.5 acres of vacant land in an R-1 zone. Mr. Aguilera said <br />the proposed 12 single-family lots will exceed the minimum 7,200 square <br />foot requirement and the proposed houses will range from 1,500 square <br />feet to 2,000 square feet, and will meet all setback requirements. <br />Mr. Aguilera stated Staff has reviewed this project and finds the pro- <br />posed project is in conformance with the General Plan, the proposed <br />Tentative Tract is consistent with the base zoning, the proposed project <br />is presently and will continue to be compatible to its surrounding uses, <br />and this project merits a Negative Declaration. <br />Mr. Aguilera concluded the Planning Commission, at the public hearing <br />on this item, denied the request due to insufficient street parking. <br />Mr. Aguilera advised Staff has prepared two Resolutions for this matter, <br />one for approval and one for denial; whichever action the City Council <br />desires to take can be made by adoption of Resolution No. R-137-90. <br />Mayor Gonzales asked if anyone present desired to speak on this matter. <br />Speaking in opposition to this item were - because of insufficient street <br />parking, and parking on residential lawns is prohibited; lot sizes are <br />inadequate; there would be limited or no access for emergency vehicles; <br />additional traffic that would be generated would be hazardous; poor <br />6 DE C 1 8 19,90 <br />
