Community Development Director Aguilera reported on the Appeal filed by <br />Kencor Corporation on the Planning Commission denial of File Index No. <br />DC -65-90 and the Design and Architectural Review of 61 Condominium Units. <br />Mr. Aguilera advised the proposed development is located on Canyon Vista <br />Drive, west of Reche Canyon Road, on 11.6 acres of vacant, graded, mostly <br />flat terrain, in an R-E/PC zone, and will contain 61 townhouse units <br />with a total density of 1.8 units per acre. <br />Mr. Aguilera continued this project was approved by the City Council <br />in 1982 and was not changed in 1987 when the new General Plan was <br />adopted, and was graded in 1988, allowing the site to exist. Mr. Aguilera <br />stated the current homeowners in the area were made aware of this project <br />prior to the purchase of their homes. <br />Mr. Aguilera stated the architecture of this project is of excellent <br />quality and the site plan is of superior design quality; the proposed <br />project is in conformance with the Zoning Ordinance and is consistent <br />with the General Plan, and compatible to its surroundings. This pro- <br />posal has been issued a Negative Declaration. Mr. Aguilera said Staff <br />concludes that approval of this project will be "grandfathered" into <br />the Specific Plan as other preapproved projects will be. <br />Mr. Aguilera concluded the only action necessary by the City Council <br />this evening is for approval of the design and architectural review. <br />Mr. Aguilera said should there be a denial on any other grounds than <br />design and architectural review, the owner/developer would have the <br />alternative of taking legal action due to his vested rights in the <br />property. <br />Mayor Gonzales asked if anyone present desired to speak on the design and <br />architectural review only for this project. <br />Speaking in opposition to the proposed project and the design and archi- <br />tectural review were - because of the increase in traffic which is al- <br />ready a serious problem; overcrowded school conditions; proper ingress <br />or egress has not been provided; design is not consistent with surround- <br />ing area and does not blend in; density and size of lots is incompat- <br />ible with the Canyon; the Planning Commission voted this project down: <br />George Fulp, 1497 Cindee Lane, Colton <br />Alicia Jackson, 3030 Canyon Vista Drive, Colton <br />Patricia Pinkney, 3039 Prado Lane, Colton <br />Roger Heinrich, 3034 Canyon Vista Drive, Colton <br />Robert Sparks, 3029 Prado Lane, Colton <br />Key Sup Hong, 3012 Canyon Vista Drive, Colton <br />Mr. Mike Kent, representing Crestwood Corporation, 333 Foothill Boule- <br />vard, Glendora, spoke in favor of the project, stating Staff checked <br />all phases of their proposal and they have agreed to adhere to all of <br />the City's regulations and rules.
