Mr. Aguilera concluded Staff recommends approval of the three struc- <br />tures to be designated as historical landmarks in the City of Colton <br />as outlined. <br />Mayor Gonzales asked if anyone present desired to speak on this matter. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to close <br />the Public Hearing. Unanimous vote. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, to approve <br />Staff's recommendation designating three structures, as outlined, as <br />Historical Landmarks in the City of Colton. Unanimous vote. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />Community Facilities District No. 90-1 <br />Economic Development Director David Zamora reported the City Clerk will <br />conduct an Election this evening of the property owners in the proposed <br />Community Facilities District No. 90-1. It is anticipated that the vote <br />will be unanimous in favor of all the proposals on the ballot. <br />Mr. Zamora continued the City Clerk will count the ballots and formally <br />certify the results of the Election. Formal Council action determining <br />the results of the Election is also required and, following these actions, <br />the City will be authorized to issue bonds and levy taxes on behalf of <br />the District. <br />Mr. Zamora advised in order to assure that the issuance of the bonds <br />and special taxes are not subject to legal challenge by current or <br />future property owners, our Legal Counsel, Best, Best & Krieger, is <br />proposing to commence a validation action in San Bernardino Superior <br />Court. This action will take approximately sixty to ninety days, and <br />the City will then be able to proceed with negotiations for the sale <br />of bonds. <br />Mr. Zamora stated in order for the City to collect the special taxes <br />required to fund the District's debt and services, the Council must <br />adopt an ordinance specifying the procedure which will be followed. <br />The ordinance will allow the Council each year to adopt a budget and <br />resolution authorizing the necessary taxes, subject to the limitations <br />of the Community Facilities District. <br />Mr. Zamora concluded Staff recommends the City Council consider First <br />Reading of Ordinance No. 0-17-90, and waive full reading, and adopt <br />Resolution Nos. R-125-90, R-126-90 and R-127-90. <br />City Clerk Ramos canvassed the voted ballots for, and the results of, <br />the Special Election, November 6, 1990, for Community Facilities District <br />No. 90-1 (Mt.
