City Attorney Edwards advised the Council that our City ordinance <br />requires response to the appeal applicant within 40 days. The applicant <br />needs to request waiver of this requirement and so state. <br />Mr. Bruce Manakas representing Maclin Markets Inc. was asked if he <br />would waive the 40 day response time in requesting continuance of appeal. <br />Mr. Manakas responded, yes. <br />On Council consensus, the Public Hearing on File Index C-54-90 was <br />continued to November 20, 1990. <br />COMMUNITY DEVELOPMENT DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Fencing <br />Swimming Pools <br />Community Development Director Aguilera reported that existing ordinance <br />does not allow for wrought iron fences due to its restrictions of the <br />size of the openings. Since wrought iron fencing is a viable form of <br />protecting pool areas, staff is proposing an amendment to the ordinance. <br />Mr. Aguilera stated if Council concurs, staff would recommend waiver <br />of full reading and adoption of First Reading of Ordinance No. 0-14-90. <br />Moved by Councilman Lofy, seconded by Councilman Rios, to waive full <br />reading and pass First Reading of Ordinance No. 0-14-90. Unanimous vote. <br />ORDINANCE NO. 0-14-90 - AN ORDINANCE OF THE CITY OF COLTON AMENDING <br />(First Reading) ORDINANCE 0-13-87 SECTION 15.24.040 TO ALLOW <br />FOR A VARIETY OF FENCE TYPES AS PROTECTION <br />DEVICES AROUND SWIMMING POOLS. <br />Fees <br />Vehicle Abatement <br />Community Development Director Aguilera referred to Council meeting of <br />September 18, 1990, in which Council approved second reading of the <br />Vehicle Abatement Ordinance and authorized staff to submit a fee which <br />would be utilized to offset costs in enforcing the ordinance. Staff has <br />included in their analysis of potential costs which include supervision, <br />benefits, and overhead. <br />Mr. Aguilera recommended approval of Resolution No. R-115-90 establish- <br />ing fees for the vehicle abatement program. <br />Moved by Councilman Lofy, seconded by Councilman Rios, to approve <br />Resolution No. R-114-90.
