Recommend denial. <br />(13) WQCP/Property <br />Purchasing of Property for Tertiary Treatment Facility <br />(R.I.X.). <br />(14) Agreements <br />Authorization to Execute Contract Agreement for R.I.X. <br />Facility. <br />Mayor Gonzales reported Mr. George Fulp has requested discussion on <br />item 14 on the Agenda, therefore, this item will be removed from the <br />Consent Calendar. <br />City Manager Sotelo requested that Item 4. on the Consent Calendar, <br />Funds for Water Quality Control, be continued for two weeks to <br />allow for further study. <br />Moved by Councilwoman Cisneros, seconded by Councilman Lofy, to approve <br />the Consent Calendar with the exception of Item 4 and 14. <br />Unanimous vote. <br />(14) Agreements <br />Mr. George Fulp, 1497 Cindee Lane, stated his concerns with regards <br />to the R.I.X. Facility Agreement. Mr. Fulp said this was a pilot <br />program and is a joint venture with the County of San Bernardino. <br />After one year the facility will be inspected by the Federal EPA. <br />If the City does not receive a good grade at the one year period, <br />they can in fact terminate the project. The amount spent on the <br />pilot project is down the drain and the City will have to fund a <br />more expensive project. Mr. Fulp stated he is worried about the <br />liability to the City in the event San Bernardino dumps something <br />toxic into the system since the City will be the operator and he <br />hopes there is language in the agreement to protect the City. <br />Public Works Director, John Hutton, reported testing procedures have <br />been established through the Regional Water Quality Control Board. <br />Certain levels have to be met at the secondary facility, both at <br />the City of San Bernardino and in Colton. The testing procedures <br />must be met before the effluent is brought over to the tertiary <br />treatment. <br />2 FE9 1 9 199�1 <br />
