(14) Agreements Authorization to Execute Contract Agreement for R.I.X. Facility. Mayor Gonzales reported Mr. George Fulp has requested discussion on item 14 on the Agenda, therefore, this item will be removed from the Consent Calendar. City Manager Sotelo requested that Item 4. on the Consent Calendar, Funds for Water Quality Control, be continued for two weeks to allow for further study. Moved by Councilwoman Cisneros, seconded by Councilman Lofy, to approve the Consent Calendar with the exception of Item 4 and 14. Unanimous vote. (14) Agreements Mr. George Fulp, 1497 Cindee Lane, stated his concerns with regards to the R.I.X. Facility Agreement. Mr. Fulp said this was a pilot program and is a joint venture with the County of San Bernardino. After one year the facility will be inspected by the Federal EPA. If the City does not receive a good grade at the one year period, they can in fact terminate the project. The amount spent on the pilot project is down the drain and the City will have to fund a more expensive project. Mr. Fulp stated he is worried about the liability to the City in the event San Bernardino dumps something toxic into the system since the City will be the operator and he hopes there is language in the agreement to protect the City. Public Works Director, John Hutton, reported testing procedures have been established through the Regional Water Quality Control Board. Certain levels have to be met at the secondary facility, both at the City of San Bernardino and in Colton. The testing procedures must be met before the effluent is brought over to the tertiary treatment. 2 FE9 1 9 199�1
