Mr. Fulp said the Council should not go forward until proper appraisals <br />and a second legal opinion are obtained. <br />Mayor Gonzales stated that one of the best crime deterents are sports <br />and the City is a sports oriented community lacking in parks. This <br />park would assist the City in this area. <br />Mrs. Cindy Silva, 531 West Martin, said she is for the park. The <br />soccer teams play at the Junior High and the league has grown too <br />big and more fields are needed. <br />Mrs. Diedre Bennett, Parks & Recreation Commissioner, stated the <br />Commission voted in favor of the park. She stated she was asking the <br />Council to ensure that the project would include the amenities requested <br />to make a true "Turn Key" park. <br />Mr. Fred Cordova, Planning Commissioner, said all of the confusion <br />could have been easily avoided if the Council had had all the minutes <br />of the two commissions, as well as, the staff and legal reports. <br />Mr. Ramon Hernandez, Planning Commissioner, asked that the Council <br />deal with the present, many people have spent countless of hours on <br />this matter. If the Council is truly concerned, the interest earned <br />in the Park Fund should be put back into the Park Fund. <br />Mr. Sal Rios, Recreation and Parks Commissioner, said he was a little <br />confused; however, he knows the Commission made a determination in <br />favor of the park. Mr. Rios recommended that the Council obtain a <br />second opinion on the legal aspects. <br />Mr. Bruce Carr, 1150 No. La Cadena Drive, asked if the City is in <br />fact getting a 5 acre park or a retention basin. <br />Community Development Director Aguilera stated the agreement calls <br />for dedication of 5 acres, of the 5 acres 1 -3 1/2 acres depending <br />on depth, will be used for a retention basin. <br />Mr. John Reichel said he worked with 4 City Managers in the last two <br />years and it is very difficult to coordinate all that has transpired <br />from one person to another. Mr. Reichel said in the last six months, <br />he has attempted once again to get all documents entered into the record. <br />and he has been run ragged. The City does have a set procedure, an <br />ordinance. The ordinance provides for dedication of land in lieu of <br />fees. There is an option. According to the ordinance, the dedication <br />requirement is 3.5 acres of land. It does not require anything more <br />than land, maintenance is not required. Mr. Reichel summarized his <br />agreement with the City; 5 acres dedicated land, $265,000 of improvements, <br />maintenance provided by the district. Mr. Reichel also outlined the <br />benefits in infrastructure being provided as a result of the Community <br />Facilities District on his project. Mr. Reichel said the San Bernardino <br />County Flood Control District has informed him that the flood <br />fees were incorrectly charged to him and that he in fact, paid <br />double.
