COMMUNITY FACILITIES DISTRICT NO. 90-1 (MT. VERNON CORRIDOR) OF THE CITY OF COLTON, COUNTY OF SAN BERNARDINO, CALIFORNIA, AND WAIVING CERTAIN REQUIREMENTS SET FORTH IN A FUNDING, CONSTRUCTION AND ACQUISITION AGREE- MENT RELATING TO SAID COMMUNITY FACILITIES DISTRICT. RESOLUTION NO. R-19-91 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY COLTON, CALIFORNIA APPROVING THE PURCHASE OF REAL PROPERTY FOR USE AS A MUNICIPAL PARKING FACILITY AND ACCEPTING SUCH PROPERTY ON BEHALF OF COMMUNITY FACILITIES DISTRICT NO. 90-1 (MT. VERNON CORRIDOR) OF THE CITY OF COLTON. Roads & Highway Claim/SB 325 City Manager Sotelo reported the City of Colton's allocation share of the Local Transportation Fund has been determined to be $234,522. In order to receive these funds for utilization on Colton's streets and roads, the City Council needs to adopt a resolution and direct staff to submit the TDA Article 8a claim and that is staff's recommendation. Moved by Council Member Rehrer, seconded by Council Member Roman, to adopt Resolution No. R-20-91 and direct staff to submit the TDA Article 8a Claim. Unanimous vote. RESOLUTION NO. R-20-91 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, SAN BERNARDINO COUNTY, STATE OF CALIFORNIA, AUTHORIZING A CLAIM FOR SB -325 ROADS AND HIGHWAY FUNDS FOR THE CITY OF COLTON. CLOSED SESSION: City Manager Sotelo requested a Closed Session at the end of the meeting for the pupose of Personnel Matters and Litigation. CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: Inland Valley Development Agency City Attorney Edwards reported the Inland Valley Development Agency (IVDA) is a party to several lawsuits. Included are lawsuits filed by San Bernardino Unified School District and by the County Superin- tendent of Schools, these cases have been settled to the satisfaction of IVDA. Attorney Edwards stated the settlement is described in in the documents included in the Council packet. The documents include a letter from Sabo & Green, Attorneys for IVDA, requesting that Colton City Council approve signing the attached "Stipulation for Entry of Judgement". The attached resolution approves the execution of the "Stipulation for Entry of Judgement", adoption is recommended. 7
