Councilwoman Cisneros informed that she had received a number of inquiries about any <br />downgrading of the 16 homes. These residents are concerned with having a new developer <br />whether the Planning Department will have to approve any changes. She said she had <br />received complete reports from the City Manager which she will be making available to the <br />residents. She asked if Planning Director Aguilera would be available to answer the question. <br />Community Development Director Aguilera stated that as with any new developer, there <br />would be inspections and approvals to be determined. The project would go before the <br />Planning Commission. <br />Motion by Councilrnember Cisneros, seconded by Councilmernber L.ofy, to approve and <br />accept the Consent Calendar except for all of the Agenda items referring to any community <br />facilities districts. Councilmernber Cisneros interjected that she wanted to see the CFD <br />residents' concerns addressed. Unanimous vote. <br />Mayor Gonzales asked staff to do a workshop session regarding the community facilities <br />districts. Financial Services Manager Young alerted City Council that the County of San <br />Bernardino has a deadline to set tax rate if the bonds are to be paid, if the matter is <br />continued to the next regularly scheduled meeting, the county deadline will not be met. Mr. <br />Young suggested City Council to continue to a Special Adjourned fleeting. City Manager <br />Mewls warned that if the deadline is not meta bonds will go into default, leaving the City open <br />to litigation and possible bankruptcy. Mr. Lewis stated that the issues raised are addressable <br />with respect to request of payment to the actual bond. if the City defaults, there will be <br />litigation between the City and the trustee. City Council and Staff can move forward and <br />meet with the resident group, <br />At this time, Councilwoman Cisneros declares, "We have all the time in the world, lets <br />explain it (CFDs) tonight." Mr. Levis accepts the directive and requests a brief recess to <br />organize his thoughts and invites Mr. Young and Mr Aguilera to join him at the dais. <br />At 8:05 P. M., Mayor Gonzales declared a brief recess to allow staff to prepare and meeting <br />reconvened at 8:12 P. M., all Councilmernbers present. <br />City Manager Lewis explained that the individual Mello -Roos Districts all pre -date present <br />staff. Mello -Roos is a financing vehicle designed to help developers and cities to help defray <br />costs of development. Draining system, street improvements, street lights, parks and other <br />amenities. In addition to helping city and developers to defray costs, it permitted the <br />homebuyer to purchase a home at a louver price, There the purchaser may be looping at a <br />$180,000 horned the selling price would be $150,000 with hard costs W for police/fire <br />services, draining systems, street improvements and parks - passed on to the Mello -Roos <br />District. Mr. Lewis pointed out that the Mello -Rohs documents contain permissive language. <br />It states that the funds can be used for certain things as storm drains, parks, curbs, gutters` <br />street lights, fire station, or schools.
