CERTIFICATION OF AN ENVIRONMENTAL IMPACT REPORT PREPARED IN <br />CONNECTION THEREWITH <br />City Attorney Derleth addressed the potential conflict of interest on this item and <br />identified one of the six council members with a possible conflict. Further discussion by <br />Council that the Public Hearing for this matter would be placed on hold until direction <br />from FPPC was received to insure that every councilmember participating in the vote <br />would be protected from conflict. City Attorney Derleth requested direction from council <br />to staff to get FPPC opinion, and directed all public comments on this item be presented <br />during public comment. <br />Motion/second by CM Ramos/Zamora to direct staff to get FPPC opinions on status of <br />possible conflict for six councilmember's and place a hold on public hearing until <br />response received from FPPC. <br />Discussion followed with CM Hernandez and CM Mitchell speaking against the motion <br />and CM De La Rosa and Mayor Bennett speaking in favor of waiting for FPPC opinion <br />on this matter. Motion/second: CM Ramos/De La Rosa to call for the question that ends <br />all debate. <br />Vote: Motion carried with CM Hernandez and CM Mitchell voting "NO". <br />RECESS: <br />At 6:30 p.m. Mayor Bennett announced a recess and at 6:53 p.m. the meeting was <br />reconvened with all members present heretofore. <br />PUBLIC HEARINGS: (continued <br />South Annexation #S-50 <br />This was the time and place fixed to consider the continued public hearing from June 17, <br />2003, approval of the Pre -Zone for South Annexation #S-50 (File Index Number DAP - <br />000 -030), located in the S/W portion of the City, south of the Santa Ana River and west <br />of La Cadena Drive. <br />Mayor declared the Public Hearing Open. <br />City Clerk Barrera declared that the Notice of Continuance regarding the Public Hearing <br />is on file in the City Clerk's Office and 28 protests or objections were received. <br />CM De La Rosa announced that he would recuse himself from discussion due to Conflict <br />of Interest as he owns property within 500 yards of the project. CM De La Rosa left the <br />dais. <br />Community Development Director Zamora presented an overview of the agenda report <br />and presented staff and Planning Commission recommendation to adopt Ordinance No. <br />0-13-04 and Negative Declaration and approval of Pre -Zone No. DAP -000-030. <br />City Manager Parrish asked that Community Development Director Zamora further <br />explain the pre -zone. <br />2003 JULY 01 REG CC/RDA/CUA MEETING - 2 - <br />
