f�1 <br />South Annexation #S-51 <br />This was the time and place fixed to consider the continued public hearing from June 17, <br />2003, approval of the Pre -Zone for South Annexation #S-51 (File Index Number DAP - <br />000 -031), located in the S/E portion of the City, East and West of Reche Canyon Road, <br />South of Fern. <br />Mayor declared the Public Hearing Open. <br />City Clerk Barrera declared that the Notice of Continuance regarding the Public Hearing <br />is on file in the City Clerk's Office and have not received any protests or objections. <br />Community Development Director Zamora presented an overview of the agenda report <br />and presented staff and Planning Commission recommendation to adopt Ordinance No. <br />0-14-03 and Negative Declaration and approval of Pre -Zone No. DAP -000-031. <br />CM Hernandez requested further explanation on what would be done to those not in <br />compliance with Specific Plan and the results if property is sold. Community <br />Development Director Zamora explained that property owner would be allowed to <br />continue use as it will not cease for 90 days, if and when discontinued they will need to <br />come into compliance with any regulations that govern area they reside in. CM Mitchell <br />questioned the limit of one acre vs. '/2 acre. City Attorney Derleth confirmed that the <br />rules of legal non conforming use would apply to that property. <br />PUBLIC COMMENT: <br />The following citizens addressed the Council: <br />Ed Braun, expressed that he had attended the meeting discussing the minimum size of <br />%2 acre versus 1 acre which he supports, as this will change the design of the area. He <br />further asked for verification of Marlow Street as it does not exist. Community <br />Development Director Zamora responded to the concerns. <br />Motion/second by CM Ramos/Zamora to terminate public hearing. Unanimous vote. <br />Motion/second by CM Ramos/Zamora to waive full reading and pass first reading of <br />Ordinance No. 0-14-03. Unanimous vote. <br />Signs <br />This was the time and place fixed to an Ordinance of the City of Colton amending <br />Chapter 18.50 (Signs) of the Colton Municipal code and adopt the Zone Ordinance text <br />amendment. <br />Mayor declared the Public Hearing Open. <br />City Clerk Barrera declared that the Affidavit of Publication regarding the Public Hearing <br />is on file in the City Clerk's Office and have not received any protests or objections. <br />Community Development Director Zamora presented an overview of the agenda report <br />and presented staffs recommendation to approve File Index No. DAP -000-163 to amend <br />2003 JULY 01 REG CC/RDA/CUA MEETING - 4 - <br />
