----1 Motion/second by CM Mitchell/Suchil to waive full reading and pass first reading of Ordinance <br />No. 0-23-05. Motion Failed with CM Mitchell/Suchil/Chastain voting "YES", CM De La Rosa <br />and Mayor Bennett voting "NO" and CM Ramos/Hernandez absent. <br />Discussion continued with CM De La Rosa asked Utilities Manager Olko to further explained <br />procedure used for notification of the community on utility rate increases and need for correction <br />to current 2% rate discounts to the community, late fee, plan development and summary and <br />status on current contact customers. Discussion continued with request to City Attorney on <br />procedure to reconsider the motion and vote. <br />At 8:22 p.m., City Attorney declared a recess for a procedure clarification on motion of <br />reconsideration and at 8:38 p.m., the meeting was reconvened with all Members present there <br />from. <br />City Attorney Derleth clarified the procedures for the Motion for reconsideration requiring a <br />motion to eliminate prior motion, and new motion to include direction to staff on the following: <br />1. Discontinuation of 2% discount <br />2. Late fee <br />3. Develop a plan <br />4. Summary and status on current contract customers. <br />Motion/second by CM Suchil/Mitchell to reconsider and eliminate previous motion. Motion <br />carried with CM Ramos/Hernandez absent <br />Motion/second by CM Suchil/Mitchell to waive full reading and pass first reading of Ordinance <br />No. 0-23-05 to include the following: <br />1. Discontinuation of 2% discount <br />2. Late fee <br />3. Develop a plan <br />4. Summary and status on current contract customers. <br />Motion carried with CM Ramos/Hernandez absent <br />ORDINANCE: <br />Waive Full Reading and Pass First Reading of an Ordinance Regarding Emergency Access <br />Devices for Controlled Access Gates at Multi -Unit Residential Properties, ORDINANCE NO. 0- <br />24-05. <br />Motion/second by CM Suchil/De La Rosa to waive full reading and pass first reading of <br />Ordinance No. 0-24-05. Motion carried with CM Ramos/Hernandez absent. <br />• Presentation Officer Lou Gamache introduced Kristy Dana and Carol Grubbs and <br />recognized them both with certificates for their excellence in innovations. <br />regarding the emergency access devices for the access gates at the <br />apartment complexes that they managed. <br />PUBLIC COMMENT: <br />2005 DECEMBER 06 REG CC/RDA/CUA MEETING - 5 - <br />
