Substitute motion/second by CM Ramos/Hernandez to approve the Street Name Change as <br />requested. CM Hernandez requested clarification from the City Attorney. City Attorney Derleth <br />clarified that during a discussion a substitute motion and second can be made and action must <br />be taken on the substitute motion before you take action on the original motion. Since CM <br />Hernandez has second on the substitute motion, action must be taken to approve the <br />Resolution to accept the street name change. City Attorney explained that because it is a <br />Resolution required by statute it would take four votes to pass the Resolution. Motion failed with <br />Mayor Bennett, CM Suchil and CM Mitchell voting "NO" and CM Hernandez and CM Ramos <br />voting "YES" and CM Chastain/De La Rosa absent. <br />Original motion carried with Mayor Bennett, CM Suchil and CM Mitchell voting "YES" and CM <br />Hernandez and CM Ramos voting "NO" and CM Chastain/De La Rosa absent. City Attorney <br />Derleth clarified that the action was not a resolution therefore it passed with a majority of the <br />quorum being 3 to 2. Resolution required by statute requires four votes regardless of the <br />quorum that is present the motion to deny is not a motion to approve a statutorily required <br />resolution therefore it can pass with the majority of the quorum, 3 to 2 is a majority of the <br />quorum so denial of the resolution passes 3 to 12 with direction to bring back policy. <br />(14) CUA/Award of Bid/E.S. Babcock & Sons/Clinical Lab — Authorize the Award of Bid for <br />the Wastewater Laboratory Analysis to E.S. Babcock & Sons in an Amount Not -To - <br />Exceed $40,938.80; and Award of Bid for the Water Laboratory Analysis to Clinical Lab <br />in an Amount Not -To -Exceed $133,575.00. <br />Motion/second by Mayor Bennett and CM Suchil to approve the award of bid for the Wastewater <br />Laboratory Analysis to E.S. Babcock & Sons. Motion carried with CM Chastain/De La Rosa <br />absent. <br />Mayor Bennett asked why the local bidder located in the City of Colton was not considered. <br />WaterA/Vastewater Director Frazer explained the bidding process used to select the business. <br />Motion/second by Mayor Bennett and CM Suchil to deny the award of bid for the water <br />Laboratory Analysis to Clinical Lab and direct staff to re -bid with new criteria and benefits to <br />local companies. Motion carried with CM Mitchell voting "NO" and CM Chastain/De La Rosa <br />absent. <br />CONSENT CALENDAR <br />(5) Warrants — Approved payroll disbursement listing for 1/28/05, Totaling, $833,297.82; <br />Warrant Register for 1/6/05, Totaling, $240,212,76; Warrant Register for 1/13/05, <br />Totaling, $411,130.27; and Warrant Register for 1/20/05, Totaling, $368,051.18 on file in <br />the Finance Department. <br />(6) Permit — Approved the Reservation Request from Calvary Chapel Colton, for a Youth <br />Concert, to be held at Fleming Park on March 25, 2005. <br />(7) Grant/Childcare — Approved and Adopted Resolution of the City Council of the City of <br />Colton Accepting the FY 2004-2005 Target Grant, RESOLUTION NO R-10-05. <br />(8) Contract/CH2MHill - Approved the Amendment to the Professional Services Agreement <br />with CH2M Hill in an Amount of $5,000. <br />
