Motion/second by CM Hernandez/De La Rosa to approve and adopt Resolution to Overturn the <br />Planning Commission Recommendation, RESOLUTION NO. R-103-05. <br />Discussion after the motion, CM Ramos asked staff if they had a chance to verify the grade <br />variations as presented by the applicant. Planning Manager Soto responded they have not had <br />a chance to verify but he tends to believe it is correct; Community Development Director <br />Zamora concurred with Planning Manager Soto. <br />In addition, CM Ramos asked staff if they know if the exhibit (Average Difference slide) was <br />prepared by a civil engineer. Community Development Director Zamora asked the applicant in <br />the audience and the applicant concurred it was. <br />Mayor Bennett commented she went out to look at the site instead of waiting to get the <br />information from Ashley as to the need for additional footage. Staff had indicated that there <br />would be study conducted by Cal State Chico and that has been provided and although she did <br />get the information until today she reviewed the document this evening. The project is an <br />important issue; the more revenue received the lower the taxes and better service will be <br />provided to the community. Regarding the comment of the mall that is located below grade and <br />the fact that it does not have towering signs that mall's business is not good even though it is <br />located by the freeway and it could be due to a signage problem. <br />City Attorney Derleth commented for understanding as to the motion the city attorney read the <br />alternative resolution title: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON UPHOLDING THE PLANNING COMMISSION'S APPROVAL, IN PART, OF DAP - <br />000 -449, WHICH INCLUDES DESIGN REVIEW, A CONDITIONAL USE PERMIT AND MAJOR <br />VARIANCE FOR APROPOSED 63,796± SW. FT. RETAIL SALES, SOTRAGE AND <br />RESTAURANT BUILDING WITH OVERHEIGTH FREEWAY ORIENTED SIGNS, ADDITIONAL <br />SIGNS, REDUCED PARKING AND AN OVERHEIGHT BUILDING WITH A MAXIMUM HEIGHT <br />OF 70 FT. ON PROPERTY LOCATED AT 855 ASHLEY WAY. <br />CM Ramos inquired as to motion including the reader board and if so is there any way to <br />separate that portion. City Attorney Derleth affirmed that the motion is for the entire project. <br />CM Hernandez, the maker of the motion stated his motion includes the reader board. <br />Vote on the Motion: Motion carried with CM Ramos and CM Mitchell voting NO. <br />Rask: FPP <br />This was the time and place fixed to consider a resolution amending the basic fee for <br />Stormwater Services .and the Stormwater Management User Fee as provided in Chapter 14.01 <br />of the Colton Municipal Code. <br />The Mayor declared the Public Hearing open. <br />City Clerk Barrera announced that the Notice of Public Hearing is on file in the City Clerk's <br />Office and no Protests or Objections have been received. <br />City Engineer Jakher presented a synopsis of the staff report for Council consideration and <br />requested approval of staff's recommendation. <br />2005 AUGUST 16 REG CC/RDA/CUA MEETING - 5 - <br />
