Motion /second by CM Hernandez/De La Rosa to close public hearing. Motion carried. <br />Discussion and clarification began with CM Mitchell who discussed with Ashley representatives <br />(teleconference) a month ago and they agreed with 60'. However, information that was <br />requested at the council meeting of August 16, 2005 was received today. This did not allow for <br />sufficient time to review and evaluate the information provided and would not support the 70' <br />request. <br />CM Hernandez stated he has a marketing degree and explained as to why he is supporting the <br />request of 70' as it relates as to the location of the business as it sits next to the freeway. He <br />also spoke with the representatives for clarification and the information is consistent with the <br />information provided this evening and will support the request of the applicant. <br />CM De La Rosa made comment that council takes their job seriously and information that is <br />needed can be obtained from staff and the applicant in order for council to make a decision. He <br />continued to say that it is important that every applicant is treated fairly in order so other <br />business will do business in Colton. CM De La Rosa has been out to the site to evaluate the <br />proposed site and along with the information the applicant has provided asked that the council <br />support the request of the applicant because this business will assist the city and the applicant <br />provided appropriate reasoning for the 70. <br />CM Suchil indicated he was also present at the teleconference that included CM Mitchell and <br />when the change went from the agreed 60' to 70' he fell back on his old habits that he used as a <br />planning commission and that was to do his own homework and researched the information and <br />feels comfortable in supporting the request of the applicant. <br />CM De La Rosa referred to the number of potential jobs as stated by the applicant and asked if <br />these positions are these existing or new positions; Ashley Furniture representative Haynes <br />responded that there would be a number of new jobs. <br />CM Ramos commented she is going to look at both sides. As CM Mitchell comment he did not <br />receive the information until today and she agrees it ,would have been better, if it had been <br />received last week with the rest of the agenda packet. On the other side, CM Ramos did do her <br />homework and they are now asking for 20' and the 10' initially granted because it was below <br />grade and believes the 60' would have sufficed. There is a mall in the City of San Bernardino <br />that was built below grade and there are no towering signs; the information provided looks good <br />but is not convinced. <br />CM Mitchell commented he does his homework but information was not provided until today. <br />When calls were made by other members of the council information was provided to the callers, <br />however, the rest of the council did not receive the same information until today. <br />CM Hernandez commented he has review the information in front of him and this is a request <br />for 20' variance and the grade is 19', therefore, this would warrant the additional 20'. <br />CM Hernandez asked of legal council that the resolution to support the planning commission <br />decision and staffs recommendation and what happens if council does different. City Attorney <br />Derleth responded that the agenda packet has two (2) resolutions and the same resolution <br />number can be applied to the resolution council wants approve; the resolution to overturn the <br />planning commission decision is marked "alternative resolution." <br />2005 AUGUST 16 REG CC/RDA/CUA MEETING - 4 - <br />
