CITY OF COLTON CLOSED SESSION - COUNCIUREDEVELOPMENT AGENCY/COLTON UTILITY AUTHORITY AUGUST 15,2006 Closed Session Meeting was held on the above given date at 5:09 p.m., in the Council Chambers of City Hall, with Mayor Pro Tempore Mitchell presiding. CITY COUNCIL ROLL CALL Councilmembers present were, Ramos, Chastain, Hernandez, and Mayor Pro Tempore Mitchell. Arrived late CM Suchil and De La Rosa and Mayor Bennett absent. City Attorney Derleth announced that the City Council would meet in Closed Session to discuss items A through C. CLOSED SESSION: A. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION Pursuant to Government Code section 54956.9(a) Name of Case: Hugo Neu-Proler Co., dba Colton Iron & Metal v. City of Colton Case Number: San Bernardino County Superior Court Case No. SCVSS 121249 B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Significant exposure to litigation pursuant to Government Code section 54956.9(b) Number of cases: 1 (Hugo Neu-Proler appeal of CUP revision) C. PUBLIC EMPLOYEE PERFORMANCE EVALUATION Pursuant to Government Code Section 54957 Title: City Manager Mayor Pro Tempore Mitchell adjourned the meeting to Closed Session at 5:09 p.m. and at 6:06 p.m.; the meeting reconvened with all members present as heretofore with Mayor Bennett absent.
