This was the time and place fixed to consider the continued Public Hearing from June 20, 2006 <br />regarding The Planning Commission's Denial (Without Prejudice) of File Index Number Dap - <br />000 -546, A Request For Modification To The Conditions Of Approval For Existing Conditional <br />Use Permit No. City Council Resolution Number 2843 to permit the construction of a 264 S.F. <br />metal building and other improvements located at 790 East "M" Street — APN No: 163-141-18: <br />Applicant/Appellant: Hugo Neu-Proler Company. <br />Mayor Bennett declared the Public Hearing open. <br />City Clerk Barrera said the Notice of Continuance calling the Public Hearing was on file in the <br />City Clerk's Office and stated that no protests or objections were received. <br />Community Development Director Zamora gave an overview of the agenda report and <br />requested approval of staff's recommendation to deny the appeal of the applicant and adopt the <br />resolution to uphold the Planning Commission decision. <br />PUBLIC COMMENT <br />Mary Graybill, representing Colton & Iron Metal spoke in support of the appellant to overturn the <br />Planning Commission decision. <br />Steve Rios and Andrew Keller, representing Colton Iron & Metal, gave a PowerPoint <br />presentation an overview of the Colton Iron & Metal as it related to the environmental findings <br />and spoke in support of the appellant to overturn the Planning Commission decision. <br />Attorney John Bowman, Legal Counsel representing Colton Iron & Metal, spoke in support of <br />the appellant to overturn the Planning Commission decision. <br />Linda Ramsey, explained she was available to answer questions as it relates to the permit <br />process (Colton Iron & Metal). <br />Jess Vasquez, spoke in support of the appellant to overturn the Planning Commission decision. <br />Chuck Siroonian, representing Pacific Rail, spoke to uphold the Planning Commission decision. <br />Levi Rosu, speaking on behalf of Pacific Rail informed the Council of the fact that Colton & Iron <br />Metal did dispose of batteries back in the 1980's. <br />Roger Griffin, representing Pacific Rail, spoke to uphold the Planning Commission decision. <br />Lenny La Rocco, General Manager of Pacific Rail, spoke to uphold the Planning Commission <br />decision. <br />Apolinar Espudo, spoke to uphold the Planning Commission decision. <br />Frank Gonzales, spoke to uphold the Planning Commission decision. <br />Ray Abril, spoke to uphold the Planning Commission decision. <br />2006 JULY 18 REG CC/RDA/CUA MEETING -4- <br />
