Maintenance Facility, Due To The Existence Of A Moratorium, On Property Located At 2001 W. <br />Key Street, Cotton <br />Mayor Chastain declared the public hearing open. <br />City Clerk Padilla announced that the Notice of Continuance for the public hearing was on file in <br />the City Clerk's office and no protests or objections have been received. <br />Planning Manager Soto presented an overview of the agenda report for the Council <br />consideration and explained that this item was continued from the previous meeting in order to <br />allow the applicant to communicate with the City of Riverside regarding objections to project, <br />CEO and President met with John Kurtz from the City of Riverside and the conclusion was that <br />they would not have any problems with them working until the moratorium is: lifted, and would <br />present this to the City of Riverside Council, no definitive response has been received from the <br />city. <br />PUBLIC COMMENT — <br />None <br />Motion/second. by CM Mitchell/Suchil to close the public hearing'. Motion carried with CM De La <br />Rosa absent. <br />Discussion continued with questions from CM Suchil regarding the information provided by the <br />applicant and going forward with the granting of appeal. <br />City Attorney Derleth explained that what we have in place at this time is, to have Council <br />support the Planning Commission decision and deny the appeal and direct staff to work with the <br />applicant and change the moratorium. <br />CM Suchil asked if staff could be directed to after the moratorium and return it to Council for <br />final approval and overturning the Planning Commission decision. <br />City Manager Parrish explained that staff recommends they support the decisions and return <br />with a change to the moratorium. <br />City Attorney Derieth clarified that the item can be continued., however the way it is worded it <br />would have to return with a change on the moratorium. <br />Motion/second by CM Mitchell/Oliva uphold the Planning Commission decision and direct staff <br />to work with the applicant and the City of Riverside and work with presenting a change to the <br />moratorium and return to council for approval. Vote: Mayor Chastain, CM Oliva and CM <br />Mitchell voting "YES* and CM Toro and CM Suchil voting "NO" FAILED WITH NO MAJORITY. <br />Motion/second by CM Mitchell/Oliva to continue the public hearing until the second meeting in <br />April. Motion carried with CM De La Rosa absent. <br />PUBLIC COMMENT: <br />The following citizens addressed the council: Art Thompson, Hector Gutman, Angel Delgado, <br />Gilbert Taber, Camilia Herrera, Ray Abril and Cynthia De La Rosa. <br />2W7 MNRCH 06 REG CCIREWCUA MEETING .4- <br />
