1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16` <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28. <br />Health and SafetyCode and <br />WHEREAS, diligent search of the files of the Agency <br />and City, including the Planning Commission and Community <br />Development Department, as conducted, by Counsel for the Agency, <br />has only disclosed fragments of the Redevelopment Plan, although <br />complete files exist for those redevelopment plans adopted prior <br />to and, following the adoption of the Redevelopment Plan; and <br />WHEREAS, it must be presumed that official actions <br />were duly and. regularly taken and without any intent to make <br />an invalid use of public funds; and <br />WHEREAS, the City of Colton, prior to the adoption <br />of the Redevelopment Plan far the Cooley Ranch, Project No. 4, <br />had previously adopted. a Redevelopment Plan for the Downtown. <br />Redevelopment Area, Project No. 1, Calif. R-77, on January 7, <br />1964, by Ordinance No. 1179 of the City and a Redevelopment <br />Plan for the Downtown Redevelopment Area, Project No. 2 (Calif. <br />R-85) on January 1.8, 1966, by Ordinance No. :1263 of the City, <br />and both previously adopted redevelopment plans are in con- <br />formity with the then existing requirements of the Community <br />Redevelopment Law; therefore, it must be presumed that the <br />Agency and City have likewise adhered to the requirements of <br />the Community Redevelopment Law for the adoption of the <br />Redevelopment Plan for the Cooley Ranch, Project No. 4, and <br />that a legally complete redevelopment plan for said Cooley <br />Ranch, Project No. 4, must have been created to carry out the <br />intent of the City Council at the time of adoption of Ordinance <br />No. 1478; and <br />-2- <br />
