No acceptance of any <br />payment shall be construed as a release or as in accord and satis <br />6 faction of any claim the City may have for further or additional <br />sums payable under this Ordinance or for the performance of any <br />7 other obligation hereunder. <br />8 In the event of any holdingover after expiration or <br />other termination of any franchise granted hereunder, without the <br />9 consent of the City, the grantee shall pay to <br />compensation and damages, of not less than One tHundred he City a reasonable <br />10 (100) of its total percent <br />gross profits before depreciation and excluding <br />any special charges during said period. <br />11 <br />12 4. Section 17 of Ordinance No. 1405 is hereby amended <br />to read as follows: <br />13 Section 17. Operational Standards. <br />14 The CATV shall be installed and maintained in ac <br />with the highest and best accepted standards in the industry tocordance <br />15 effect that subscribers shall receive the highest possible service. <br />At a minimum, the grantee shall comply with all applicable federal <br />16 statutes, rules, and regulations regarding operational standards of <br />17 CATV systems. <br />18 5. Section 18 of Ordinance No. 1.405 is hereby repealed. <br />1g 6. Section 19 of Ordinance No. 1405 is hereby amended to <br />read as follows: <br />20 Section 19. Miscellaneous Provisions. <br />21 <br />A. When not otherwise prescribed herein, all matters <br />22 herein required to be filed with the City shall be filed with the <br />City Clerk. <br />23 <br />H. The grantee must pay to the City a sum of money <br />24 sufficient to reimburse it for expenses incurred by it in publish- <br />ing legal notice and ordinances in connection with the granting of <br />25 the franchise pursuant to the provisions of this chapter. Such <br />payment shall be _made in ten (10) days after the City shall furnish <br />26 such grantee with a written statement of such expense. <br />27 C. The grantee shall keep a maintenance service log <br />which will indicate the nature of each service complaint, the date <br />28 and time it was received, the disposition of said complaint and the <br />time and date cleared. The log shall be made available for periodic <br />29 inspection by the City. <br />30 D. Grantee shall bear the prime responsibility for <br />appropriate corrective action whenever improper performance is <br />31 detected in any part of the system, regardless of whether <br />utility distribution facilities are utilized, public <br />32 <br />E. No person, firm or corporation in the existing <br />-2- <br />
