I ORDINANCE NO 1587 <br />2 AN INTERIM URGENCY ORDINANCE OF THE CITY <br />OF COLTON ESTABLISHING A TEMPORARY MORA - <br />3 TORIU14 ON THE PROCESSING AND FILING OF <br />FINAL SUBDIVISION MAPS AND PROHIBITING <br />4 THE ISSUANCE OF BUILDING PERMITS FOR <br />CERTAINUSESTO ASSIST IN SOLVING THE <br />5 CITY'S WASTEWATER TREATMENT PROBLEM <br />6 <br />7 WHEREAS, the City of Colton (."Colton") has instituted <br />8 Civil Action No. 1299889 in the Superior Court of California, <br />9 County of Riverside, against the City of Grand Terrace <br />10 ("Grand Terrace") and the County of San Bernardino ("County"), <br />11 which seeks in part to prevent Grand Terrace and the County <br />12 of San Bernardino from authorizing or permitting the discharge <br />13 of additional sewage into Colton's sewerage system; and <br />14 WHEREAS, Colton has formally notified Grand Terrace <br />15 and County that wastewater treatment capacity in Colton's <br />16 Wastewater Treatment Plant has been exhausted and that Colton <br />17 has been advised by its expert engineers and wastewater con - <br />18 sultants-that the City's Wastewater Treatment Plant is being <br />19 operated at an average daily flow of 3.5 mgd which is approxi - <br />20 mately 17% greater than the design capacity for the treatment <br />21 plant; and <br />22 WHEREAS, Grand Terrace, Colton and portions of <br />23 County have experienced over the past decade unprecedented <br />24 growth with resultant pressures on existing public facilities <br />25 and services. Wastewater treatment and other related public <br />26 <br />services and facilities have been provided to meet the needs for <br />27 the growing populations of all three entities. However, Grand <br />28 Terrace, County, Colton and other public agencies have been <br />
