Y, <br />11 <br />ORDINANCE NO. 1 592 <br />2 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF COLTON ESTABLISHING A SEWER CONNECTION <br />S <br />CHARGE FOR NEW USERS OF THE CITY'S SANITARY <br />SSR. SYSTEM AND TREATI,'FENT PLANT <br />4 <br />5 <br />WHEREAS, existing residents and property owners have paid <br />6 <br />for the construction and operation of the City's existing <br />7 <br />sanitary sewer system, and wastewater treatment plant; and <br />£ <br />WHEREAS, these facilities are being overloaded by <br />9 <br />current and projected development and additional facilities <br />10 <br />must be funded and constructed as soon as possible; and <br />11 <br />WHEREAS, the City of Colton filed a lawsuit against <br />12 <br />the City of Grand Terrace and the County of San Bernardino <br />13 <br />(Case No. 129889, Superior Court of California, County of <br />14 <br />Riverside) to determine the rights of the Grand Terrace area <br />15 <br />to have its sewage treated at Colton's facilities, a-Li the <br />16 <br />resulting obligations therefor, pursuant to a 1974 agreement <br />17 <br />between Colton and the County; and. <br />18 <br />WHEREAS, pursuant to the terms of the settlement agreement <br />19 <br />entered into by the two Cities as.a result of this litigation, <br />20 <br />Colton is to enact forthwith a connection charge for new users <br />21 <br />of its sanitary sewer system and treatment plant; and <br />22 <br />WHEREAS, the immediate imposition of such a new <br />23 <br />connection charge is necessary to protect the public health, j <br />24 <br />safety and welfare of existing citizens of the City of <br />25 <br />Colton, as well as to impose a fair share of the cost of <br />20 <br />existing and planned sewage treatment Tacilities on new <br />27 <br />users of such facilities; <br />
