1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, on September 6, 2005, the City Council of the City of Colton <br />("City Council") conducted a duly noticed public hearing on the Application at which time <br />all persons wishing to testify in connection with the Application were heard and the <br />Application was fully studied; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance <br />have occurred; <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS <br />FOLLOWS: <br />SECTION 1. Based on the entire record before the City Council, all written <br />and oral evidence presented to the City Council, and the findings set forth in this <br />Ordinance, the City Council of the City of Colton hereby designates the Subject Site <br />shown on the attached Exhibit Al as within the "R-1/PC" (Single Family <br />Residential/Planned Community Overlay) zoning district as defined in Chapter 18.12 and <br />Chapter 18.32 of the Colton Municipal Code. <br />SECTION 2. Based on the entire record before the City Council and all <br />written and oral evidence presented, the City Council finds that the Application is <br />consistent with the City of Colton General Plan ("General Plan"), and will systematically <br />implement the goals and objectives of the General Plan. Moreover, the City Council <br />hereby makes the following specific findings in accordance with Section 18.58.050 of the <br />Colton Municipal Code and state law: <br />A. The proposed zone change is in conformity with the General Plan of <br />the City because a general plan amendment request is being considered concurrently <br />with this Application request. The general plan amendment changes the land use <br />designation of the Subject Property from Low Density Residential to Low Density <br />Residential/Planned Community." The proposed R-1/PC zoning designation is <br />consistent and in conformity with the proposed general plan amendment for the Subject <br />Site. In addition, the R-1/PC zoning district provides for land uses compatible with <br />surrounding property and the Colton Municipal Code. Moreover, the Planned <br />Community Overlay permits development of the Subject Site with greater flexibility in <br />design to encourage a variety of housing types and a more creative development <br />approach. <br />B. The proposed zone change is reasonable and beneficial at this time <br />because it will not be a significant change of the existing uses on site. The Subject Site <br />will remain available for single family residential development, with more flexible <br />development standards. <br />C. The proposed change of zone will not adversely affect the <br />surrounding area or the community in general. The Subject Site is surrounded by <br />ORANGE\MXM\19245.1 - 2 - <br />
