Based on the entire record before the City Council and all <br />written and oral evidence presented, the City Council, in accordance with the California <br />Environmental Quality Act (CEQA), the City of Colton implementing procedures for CEQA <br />and the State CEQA Guidelines, hereby determines that the recommendation and adoption <br />of the proposed resolution and ordinance is categorically exempt under section 15061(b)(3) <br />of the California Environmental Quality Act (CEQA) because the activity is covered by the <br />general rule that CEQA applies only to projects which have the potential for causing a <br />significant effect on the environment. Where it can be seen with certainty that there is no <br />possibility that the activity in question may have a significant effect on the environment, the <br />activity is not subject to CEQA. <br />SECTION 5. The zone change shall not become effective unless and until <br />the effective date of the corresponding general plan amendment for the Subject Site. <br />SECTION 6. The location and custodian of documents and any other <br />material which constitute the record of proceedings upon which the City Council based its <br />decision to find this Application exempt under CEQA as follows: David R. Zamora, City of <br />Colton Community Development Department, 659 N. La Cadena Drive, Colton, CA 92324, <br />(909) 370-5079. <br />SECTION 7. The City Council directs staff to file a Notice of Exemption and <br />a Certificate of Fee Exemption (De Minimis Impact Finding) with the County of San <br />Bernardino within five (5) working days of project approval. <br />SECTION 8. Effective Date. This Ordinance shall become effective thirty <br />(30) days after its adoption in accordance with the provisions of California law. <br />SECTION 9: The City Clerk shall certify to the passage of this Ordinance <br />and cause the same or a summary thereof to be published within fifteen (15) days after <br />adoption in a newspaper of general circulation, printed and published in Colton, California. <br />PASSED, APPROVED, AND ADOPTED, this 20th day of December, 2005. <br />ATTEST: <br />A-4/--. <br />CAROLINA P.
