The Text Amendment would rectify that error <br />and allow for more comprehensive planning review of future Transient Habitation <br />establishments. Further, the Text Amendment would encourage Transient Habitation <br />establishments to locate within the City, since the C-2 (Commercial General) Zone is the more <br />attractive location for such establishments due to the proximity of commercial facilities and <br />amenities. Thus, the Text Amendment will assist the City in meeting its economic development <br />and service needs. <br />C. The Text Amendment will not adversely affect the surrounding area or the <br />community in general. The C-2 zoning designation's development standards provide adequate <br />separation and height requirements to assure that any proposed Transient Habitation <br />establishments do not significantly adversely affect surrounding areas. Further, other <br />development standards in Chapter 18.22 of the Colton Zoning Ordinance assure that any <br />development or conversion to a Transient Habitation use undertaken pursuant to this Text <br />Amendment is compatible with and will not adversely affect surrounding uses. <br />D. The City Council has determined the Text Amendment is in the public <br />interest because it provides additional commercial development opportunities in the City of <br />Colton. <br />SECTION 4. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the Text Amendment complies with CEQA <br />and hereby adopts the negative declaration for the following reasons: <br />A. The negative declaration and initial study were prepared for the Text <br />Amendment contain a complete and accurate reporting of the environmental impacts associated <br />with the Text Amendment. The documents have been completed in compliance with CEQA and <br />the State CEQA Guidelines. <br />B. The negative declaration and initial study prepared for the Text <br />Amendment reflect the independent judgment of the City Council. <br />C. As the decision making body for the Text Amendment, the City Council <br />reviewed and considered the information contained in the negative declaration, initial study and <br />administrative record prior to approving the Text Amendment. <br />D. All environmental impacts of the Text Amendment are insignificant. There <br />is no substantial evidence in the record supporting a fair argument that the Text Amendment will <br />result in significant impacts. <br />E. The Text Amendment will not result in any changes to the following <br />resources: (1) riparian land, rivers, streams, watercourses and wetlands; (2) native and <br />non-native plant life and the soil required to sustain habitat for fish and wildlife; (3) rare and <br />unique plant life and ecological communities dependant on plant life; (4) listed threatened and <br />endangered plants and animals and the habitat in which they are believed to reside; (5) all <br />species listed as protected or identified for special management in the Fish and Game Code, the <br />Public Resources Code, the Water Code or regulations adopted thereunder; (6) all marine and <br />terrestrial species subject to the jurisdiction of the Department of Fish and Game and the <br />ecological communities in which they reside; and (7) all air and water resources, the <br />degradation of which will individually or cumulatively result in a loss of biological diversity among <br />the plants and animals residing in that air and water. <br />RVPUB\HAV IVA.SHANE\704919.1 -3 - <br />
